Defendants were not told criminal damage case could carry a terrorism connection until after they were found guilty

The Crown Prosecution Service (CPS) wants to sentence five more Palestine activists as terrorists for committing criminal damage, it can be revealed.

Brendon O’Hagan, Amanda Kelly, Hmeera Atiqnisar, Mohammed Malik, and Alma Yaniv were convicted of criminal damage last month for a protest at a Barclays bank branch in Burnley in 2024.

It was carried out in the name of Palestine Action almost a year before the group was banned under terrorism laws. 

In the agreed facts of the case, the prosecution’s lawyers acknowledged that Barclays provided investments and loans to Elbit Systems, Israel’s largest arms firm.

The court heard that the activists smashed windows and sprayed red paint over the building, with damage costs allegedly amounting to £212,805.

Court filings show that it was only after the trial concluded that the CPS decided to apply for a terrorism connection to be added to the case.

The move came after the judge overseeing the case requested submissions on whether the case should be designated as having a terrorism connection.

This means that neither the jury nor the defendants were aware that the case could carry a terrorism connection until after the guilty verdicts were delivered.

The move suggests that a ruling last month against another four Palestine Action activists, who were sentenced as terrorists by Justice Jeremy Johnson, is already having far-reaching consequences for protest-related trials in Britain.

Johnson treated the four protesters as terrorists even though they were only convicted of criminal damage at an Elbit Systems factory in the Filton area of Bristol.

Atiqnisar, one of the defendants in the Barclays case, told Declassified: “You go through a two-week trial only to be told after it’s over that you were on trial for terrorism.

“Johnson’s judgment has opened up the floodgates for potentially hundreds of activists to be sentenced as terrorists for taking direct action against genocide.

“It’s a few broken windows and red paint that they’re now saying is terrorism. It shows you the lengths the state is willing to go to in order to protect the Israeli weapons trade

Exclusive: Former home secretary was told proscribing Palestine Action within six months of key Filton hearing could prejudice the case but went ahead anyway.

Britain’s former home secretary Yvette Cooper was warned that proscribing Palestine Action could prejudice the trial of six activists but went ahead anyway, it can be revealed.

Internal documents seen by Declassified show the Crown Prosecution Service (CPS) advised Cooper not to proscribe Palestine Action within six months of any Filton hearings.

The Filton 24 are pro-Palestine activists accused of breaking into a factory owned by Elbit Systems, Israel’s largest arms firm, in Bristol in August 2024.

The CPS was concerned that proscribing Palestine Action within six months of the hearings would prejudice their right to a fair trial.

Yet Cooper went against this advice and announced the proscription of Palestine Action less than five months before the first of those trials began in November last year.

Last week, the Guardian also revealed that Cooper risked being in contempt of court by justifying the proscription of Palestine Action in a column published in the Observer.

In that article, Cooper said the charges against the defendants involved a “terrorism connection” and accused the group of “intimidation, violence, weapons, and serious injuries to individuals”.

Defence lawyers sought to argue in court that Cooper had committed an “abuse of process” by discussing details of the case that were under reporting restrictions.

Mr Justice Johnson dismissed that application despite acknowledging that Cooper was “specifically advised that going ahead with the article might prejudice these proceedings”.

Taken together, the revelations suggest Cooper prioritised securing and justifying the proscription of Palestine Action over respecting due process.

The Home Office was approached for comment.

Contrary to some reports, the Crown Prosecution Service (CPS) did not merely drop the charge of aggravated burglary lodged against all the 24. The judge ordered verdicts of not guilty, an acquittal just as concrete as any delivered by a jury. Six of the group were already acquitted on 4 February 2026.

‘Aggravated burglary’ involves burglary with prior intent to cause physical harm. The offence carries a potential life sentence and was brought by the CPS to justify the Starmer regime’s decision to ban Palestine Action as a terrorist group. The attempt was underpinned by claims from media and politicians that a policewoman’s spine was broken by the activists. In fact, the injury was only suspected, could not be identified on x-rays and will heal fully in a matter of months.

Not only that, but the prosecution presented no evidence to show the injury was caused by the activists. Instead, the only evidence of violence was entirely on the part of security guards working for Israeli weapons-maker Elbit. This caused considerable embarrassment when video evidence completely contradicted the claims of the prosecution and its witnesses. Or it would have, if the corporate media had bothered to report it.
