A HIGH COURT hearing will be scheduled on the government’s continued export of F-35 fighter jet parts to Israel, it has been confirmed.

This is the latest development in a legal challenge to the arms sales brought by Palestinian human rights organisation Al-Haq and the Global Legal Action Network (Glan).

Last September, the Labour government failed to impose a full arms embargo as Israel continued its genocide in Gaza, suspending only 30 arms export licences out of 350 in total.

Among the goods still being exported were parts for F-35 warplanes, which are used to drop 2,000lb bombs on innocent civilians.

Court documents revealed in November that the government knew there was a “clear risk” that the exports could be used to violate international humanitarian law, but it did not suspend them, claiming that such action would “have a profound impact on international peace and security” and “undermine US confidence in the UK and Nato.”

In his latest ruling on the export of arms to Israel, Mr Justice Chamberlain noted: “There is a powerful public interest in a quick, final determination of its legality, one way or the other.”

THE government has been forced to review its decision to export F-35 fighter jet components to Israel, legal groups announced today.

Global Legal Action Network (Glan) and Al-Haq wrote to the government last month, threatening to file an emergency injunction over its failure to revoke licences for all arms to the country as it continues its genocide in Gaza.

Labour eventually moved to suspend just 30 out of 350 arms exports in September, but components for F-35s, which have dropped 2,000lb bombs on Gaza, were exempt.

In the High Court last month, the government admitted that there was a “clear risk” that the components could be used by Israel to violate international humanitarian law.

But it continued to export them anyway after Defence Secretary John Healey warned that it would disrupt the global supply programme they are part of and “undermine US confidence in the UK.”

Glan and Al-Haq said that they have now been notified that the government is reconsidering its decision.

Glan lawyer Dearbhla Minogue said: “The position they took is, in our estimation, legally untenable and we hope they will finally do the only reasonable thing — stop the transfer of any British weapons for use by Israel against Palestinians.”

A COURT case against the British government over arms exports to Israel could be the most important challenge to the legal system in “generations,” arms expert Andrew Feinstein has said.

The case, brought by the Global Legal Action Network and the human rights group Al-Haq, will be heard in the High Court on Monday.

It calls on the government to suspend all arms exports, citing a clear risk that these could be used by Israel to violate international law.

Currently only 30 out of 350 licences are suspended and components for the lethal F-35 fighter jet are exempt.

Speaking to the Morning Star’s deputy news editor Ceren Sagir in a video interview, Mr Feinstein warned that if the legal system sides with the British state as it has done before, effectively allowing it to “trample” over British and international law, “then we will be able to say without a shadow of a doubt that the legal system in Britain is broken.

New court documents reveal that ministers David Cameron and Kemi Badenoch authorised UK arms sales to Israel right after an airstrike killed three British charity workers in Gaza.

On 1 April, Israeli forces launched a series of airstrikes on a convoy of aid workers in Gaza, killing three Britons, a Polish national, a Palestinian, an American-Canadian dual citizen, and an Australian.

The Israeli Air Force carried out the bombing with a Hermes 450 drone. According to Campaign Against the Arms Trade, this drone may be powered by a R902(W) Wankel engine produced in Britain by UAV Engines Limited (UEL).

New court documents show that the UK government decided to continue arms exports to Israel on 8 April, one week after the strike on the aid workers who were employed by the charity World Central Kitchen (WCK).

The revelation will put additional pressure on the Foreign Office to justify its decision not to suspend arms sales to Israel.

‘Killed with British weapons’

Global Legal Action Network (GLAN) and Palestinian human rights group Al-Haq challenged the UK government today in court over arms sales to Israel.

Documents provided to the court show that the UK government has conducted five legal assessments of the situation in Gaza since 18 December.

One of those assessments, which covered the period 18 December to 29 February, was delivered to UK foreign secretary David Cameron on 28 March.

On 3 April, two days after the Israeli airstrike on the aid workers, Cameron used this assessment to recommend that the UK continue arms sales to Israel. 

Five days later, UK trade secretary Kemi Badenoch authorised the continuation of extant licences and new licences to Israel, according to GLAN’s press statement.
