Chilean court reopens case against soldier accused of Gaza war crimes

A recent judicial ruling in Chile has revived scrutiny of a criminal complaint against an Israeli-Ukrainian soldier accused of committing war crimes in the Gaza Strip, reviving a legal debate over the application of universal jurisdiction in the country.

The Santiago Court of Appeals overturned a prior ruling by the Eighth Guarantee Court, which had refused to examine the complaint against Rom Kovtun. The appellate court ruled that the question of jurisdiction cannot be decided without hearing all parties involved. 

A public hearing is scheduled for 12th June, where the complainant, the defence, and the Public Prosecutor’s Office will present arguments on whether Chilean courts have the authority to investigate alleged war crimes, crimes against humanity, and genocide committed abroad.

The complaint was filed in February by the Hind Rajab Foundation through Chilean lawyer Pablo Andrés Araya Zacarías. It seeks Kovtun´s investigation under Chilean Law No. 20.357, which criminalises genocide, crimes against humanity, and war crimes, in line with the Rome Statute of the International Criminal Court.

According to the complaint, Kovtun served as a sniper in the 424th “Shaked” Battalion of the Givati Brigade and operated under the 401st Armored Brigade during military operations in Gaza. He is accused of participating in the siege and destruction of the Al-Shifa Medical Complex in Gaza City between March and April 2024. The operation reportedly caused extensive damage to medical infrastructure and civilian casualties, including patients and hospital staff.

Legal experts and human rights advocates caution that the Court of Appeals’ decision does not confirm the allegations or rule on the merits of the case. Its purpose is limited to determining whether Chilean courts have jurisdiction to examine the complaint. The outcome of the June hearing will decide whether Chile proceeds with a formal criminal investigation or dismisses the case as outside its jurisdiction.

Chilean lawyer and former ambassador Nelson Hadad highlighted the lack of legal consistency in Chile regarding universal jurisdiction. “This issue lacks consistent jurisprudence; that is, in most cases, the Chilean judiciary has rejected the principle of universal jurisdiction and the extraterritorial application of the law,” he said.

Regarding the upcoming hearing, Hadad noted, “In this case, there is a hearing scheduled for 10th June in which… will there be a ruling on this matter? It could perhaps be the first time.”

He emphasised the cautious approach of the judiciary and prosecutorial authorities. “The Public Prosecutor’s Office and the Judiciary as such accept some arguments to be able to prosecute in Chile this Israeli soldier responsible for numerous crimes,” Hadad explained.

At the same time, he highlighted past reluctance from Chilean authorities. “But I believe that the Public Prosecutor’s Office, especially the North Central Prosecutor’s Office where Prosecutor Armendariz is, has been consistently reluctant to accept universal jurisdiction,” he said.

Looking ahead, Hadad stressed the potential impact of a favorable ruling. “We are waiting to see what happens because if it were the opposite and it were accepted, it would set a very important legal precedent for trying numerous cases from Chile with the Chilean justice system, crimes committed abroad, in this case, crimes committed in Gaza and throughout occupied Palestine.”

He concluded with cautious optimism: “So we can talk again on 10th June, once the court has ruled on this point. But at least there is hope.”

The Hind Rajab Foundation filed the complaint, citing universal jurisdiction and Chile’s law against genocide, crimes against humanity, and war crimes.

A Brussels-based human rights group on Monday filed a criminal complaint in Chile seeking the prosecution of an Israel Defense Forces sniper accused of taking part in the deadly 2024 siege and destruction of Gaza’s largest hospital.

The Hind Rajab Foundation (HRF)—named after the young Palestinian girl who was killed in January 2024 along with six relatives and two rescue workers by IDF troops in Gaza City—said it filed the complaint in the 8th Guarantee Court in Santiago, the Chilean capital, requesting investigation and prosecution of Rom Kovtun, an Israeli Ukrainian sniper in the 424th “Shaked” Battalion of the Givati Brigade, under Chilean Law 20.357.

The law criminalizes genocide, crimes against humanity, and war crimes under the Rome Statute, the 1998 treaty establishing the International Criminal Court (ICC), which in 2024 issued arrest warrants for Israeli Prime Minister Benjamin Netanyahu and former Israeli Defense Minister Yoav Gallant for alleged murder and forced starvation in Gaza.

HRF’s complaint was formally submitted by Chilean lawyer Pablo Andrés Araya Zacarías, a partner at Silva-Riesco Abogados. The filing invokes universal jurisdiction—the legal principle empowering states to investigate and prosecute individuals for heinous crimes regardless of where they occurred—based on Kovtun’s presence in Chile and Israel’s refusal to prosecute him.

According to the complaint, Kovtun took part in the March-April 2024 siege and attack on al-Shifa Hospital in the Rimal neighborhood of Gaza City. The World Health Organization said at least 21 patients were killed during attacks on the facility, while Gaza officials claimed the toll was much higher.

Survivors and witnesses said IDF troops executed civilians during the raid on al-Shifa, including 13 children. The IDF denied the allegations. Doctors, nurses, and other hospital workers were also abducted and allegedly tortured by their IDF captors. Israeli claims that Hamas fighters were using al-Shifa as a command center were subsequently debunked as lies.

Hundreds of Palestinian bodies—some with bound limbs and signs of torture and execution—were found outside the hospital after IDF troops withdrew from the area, although it is not known if they were all killed there.

“The targeting and destruction of a functioning hospital during a military siege strike at the core of international humanitarian law,” HRF general director Dyab Abou Jahjah said on Monday. “When evidence indicates that a sniper participated in such an operation, domestic courts cannot look away. Universal jurisdiction exists to ensure that the most serious crimes do not go unexamined simply because they were committed abroad.”

HRF head of litigation Natacha Bracq said that “international humanitarian law grants special protection to hospitals, medical personnel, and the wounded.”

“The encirclement and destruction of a functioning medical complex, combined with the deprivation of food, water, and medical care, are not collateral damage—they constitute war crimes, crimes against humanity, and acts of genocide,” she added.

Israel is facing a genocide case filed by South Africa at the International Court of Justice (ICJ), which has issued multiple provisional orders for Israel to avoid genocidal acts in Gaza. Critics say Israel has ignored the orders.

Chile embraced universal jurisdiction in the decades following the fall of the US-backed military dictatorship of Gen. Augusto Pinochet, whose 1998 arrest in London for crimes against humanity stemmed from an international warrant issued by Spanish judge Baltasar Garzón based on universal jurisdiction.

HRF, which was founded in the Belgian capital in September 2024, has filed numerous legal complaints targeting alleged IDF war criminals. In one case, Israel helped an IDF soldier targeted by the group while vacationing in Brazil to flee the country in order to avoid arrest.

In October 2024, HRF filed what it called an “unprecedented” complaint at the ICC—which, like the ICJ, is located in The Hague, Netherlands—against 1,000 IDF troops accused of war crimes, crimes against humanity, and genocide in Gaza. One year later, HRF filed another ICC complaint against 24 IDF members allegedly involved in the killing of Hind Rajab, her relatives, and two paramedics.

While there have been no known prosecutions of any individuals targeted by HRF, last May Peru formally opened a probe into “an Israeli national accused of participating in the genocide in Gaza.”

Hind Rajab Foundation files criminal complaint against former Israeli soldier for war crimes in Gaza

The Hind Rajab Foundation on Wednesday filed a complaint in the US seeking a criminal investigation into war crimes and genocidal acts by Adi Karni, a former Israeli army sergeant, during Israel’s war on Gaza, Anadolu reports.

“This U.S. filing follows earlier complaints filed by HRF in multiple jurisdictions, including Peru, where a formal criminal investigation is already open against Karni for genocide,” the foundation said in a statement.

It added that the HRF has also submitted filings concerning Karni in several other countries, “as part of its strategy to ensure that jurisdiction is activated wherever he travels.”

HRF said Karni is currently present in the US and is scheduled to speak publicly at Boston University this evening, “a fact that directly engages U.S. jurisdiction and heightens the urgency of the filing.”

It noted that the complaint is based on an HRF investigative report reporting that Karni took part in demolishing civilian infrastructure and religious sites in Gaza, was involved in systematic destruction by his unit, and later publicly denied the existence of civilians while justifying attacks on civilian objects.

“The report concludes that this conduct may constitute war crimes, and, when assessed in its broader context, contribute to the legal elements of crimes against humanity and genocide,” it added.

HRF added that the filing against Adi Karni forms part of HRF’s broader mandate to “ensure that international crimes are investigated wherever jurisdiction exists, and that no country—whether in Europe, the Americas, or elsewhere—becomes a safe haven for impunity.”

Hind Rajab Foundation files war crimes complaint against former Israeli Premier Ehud Olmert

The Hind Rajab Foundation filed a criminal complaint in Germany accusing former Israeli Prime Minister Ehud Olmert of war crimes for Israel’s 2008 – 2009 military offensive in the Gaza Strip, known as Operation Cast Lead, the group said Wednesday, Anadolu reports.

German lawyer Melanie Schweizer submitted the complaint to the Berlin Public Prosecutor’s Office and the Federal Prosecutor General in Karlsruhe, which handles international crimes under Germany’s Code of Crimes against International Law (VStGB), the foundation said in a statement.

Olmert is scheduled to appear Nov. 6 in Berlin at the Haaretz Democracy Conference.

The Foundation argued that as prime minister from 2006 to 2009, Olmert held ultimate responsibility for Israeli military operations in Gaza, which it said resulted in the killing of more than 1,300 Palestinians, including more than 300 children, and widespread destruction to civilian infrastructure.

Human rights organizations, including the UN Fact-Finding Mission (Goldstone Report), Amnesty International and Human Rights Watch, previously documented alleged unlawful attacks, the use of white phosphorus in populated areas and restrictions on humanitarian access during the conflict.

Citing the principle of command responsibility, the complaint accused Olmert of authorizing, failing to prevent or failing to prosecute actions it claims amount to war crimes and crimes against humanity, it said.

The Foundation urged German authorities to launch an investigation, issue an arrest warrant and prevent Olmert’s departure from the country.

Courts may prosecute serious international crimes irrespective of where they were committed or the nationality of the suspects, under German law.

“The victims of Gaza deserve justice, no matter how much time has passed,” said Dyab Abou Jahjah, general director of the Hind Rajab Foundation. “Those responsible for war crimes must know that accountability has no expiration date and that the world is closing in on impunity.”

The Gaza Genocide: the fall of Israel’s immunity

A dramatic escape was cited by Israeli media as the reason that Yuval Vagdani, a soldier in the Israeli army, managed to escape justice in Brazil.

Vagdani was accused by a Palestinian advocacy legal group, the Hind Rajab Foundation, of carrying out well-documented crimes in Gaza. He is not the only Israeli soldier being pursued for similar crimes.

According to the Israeli Broadcasting Corporation (KAN), more than 50 Israeli soldiers are being pursued in countries ranging from South Africa to Sri Lanka to Sweden.

In one case, the Hind Rajab Foundation filed a complaint in a Swedish court against Boaz Ben David, an Israeli sniper from the 932 Battalion of the Israeli Nahal Brigade. He is also accused of committing war crimes in Gaza.

The Nahal Brigade has been at the heart of numerous war crimes in Gaza. Established in 1982, the brigade is notorious for its unhinged violence against Occupied Palestinians. Their role in the latest genocidal atrocities in the Strip has far exceeded their own dark legacy.

OPINION: Why context is important in Palestine

Even if these 50 individuals are apprehended and sentenced, the price exacted from the Israeli army pales in comparison to the crimes carried out.

Numbers, though helpful, are rarely enough to convey collective pain. The medical journal Lancet’s latest report is still worthy of reflection. Using a new data-collecting method called ‘capture–recapture analysis’, the report indicates that, by the first nine months of the war, between October 2023 and June 2024, 64,260 Palestinians have been killed.

Still, capturing and trying Israeli war criminals is not just about the fate of these individuals. It is about accountability—an absent term in the history of Israeli human rights violations, war crimes and recurring genocides against Palestinians.

The Israeli government understands that the issue now goes beyond individuals. It is about the loss of Israel’s historic status as a country that stands above the law.

As a result, the Israeli army announced that it decided not to publicly reveal the names of soldiers involved in the Gaza war and genocide, fearing prosecution in international courts.

However, this step is unlikely to make much difference for two reasons. First, numerous pieces of evidence against individual soldiers, whose identities are publicly known, have already been gathered or are available for future investigation. Second, much of the documentation of war crimes has been unwittingly produced by Israeli soldiers themselves.

Reassured about the lack of accountability, Israeli soldiers have taken countless pieces of footage showing the abuse and torture of Palestinians in Gaza. This self-indictment will likely serve as a major body of evidence in future trials.

All of this cannot be viewed separately from the ongoing investigation into the Israeli genocide in Gaza by the International Court of Justice (ICJ). Additionally, arrest warrants have been issued by the International Criminal Court (ICC) against top Israeli leaders, including Prime Minister Benjamin Netanyahu.

Though these cases have moved slowly, they have set a precedent that even Israel is not immune to some measure of international accountability and justice.

Moreover, these cases have granted countries that are signatories to the ICC and ICJ the authority to investigate individual war crimes cases filed by human rights and legal advocacy groups.

Though the Hind Rajab Foundation is not the only group pursuing Israeli war criminals globally, the group’s name derives from a five-year-old Palestinian girl from Gaza who was murdered by the Israeli army in January 2024, along with her family. This tragedy and that particular name are a reminder that the innocent blood of Palestinians will not go in vain.

Though justice may be delayed, as long as there are pursuers, it will someday be attained.

Pursuing alleged Israeli war criminals in international and national courts is just the start of a process of accountability that will last many years. With every case, Israel will learn that the decades-long US vetoes and blind Western protection and support will no longer suffice.

It was the West’s shameless shielding of Israel throughout the years that allowed Israeli leaders to behave as they saw fit for Israel’s so-called national security—even if it meant the very extermination of the Palestinian people, as is the case today in Gaza.

Still, Western governments, including the US and Britain, continue to treat wanted Israelis as sanctified heroes—not war criminals. This goes beyond accusations of double standards. It is the highest immorality and disregard for international law.

Things need to change; in fact, they are already changing.

Since the start of the Israeli war on Gaza, Tel Aviv has already learned many difficult lessons. For example, its army is no longer “invincible”, its economy is relatively small and highly dependent, and its political system is fragile. In times of crisis, it is barely operable.

It is time for Israel to learn yet another lesson: that the age of accountability has begun. Dancing around the corpses of dead Palestinians in Gaza is no longer an amusing social media post, as Israeli soldiers once thought.
