Two US immigration enforcement officers are now under federal investigation after it was revealed that they seem to have lied about the circumstances that led up to the shooting of a Venezuelan immigrant last month.

As reported by Politico on Friday, US Immigration and Customs Enforcement (ICE) Acting Director Todd Lyons acknowledged that two federal officers appear “to have made untruthful statements” about a confrontation in Minneapolis in January that culminated in one of the officers shooting Venezuelan national Julio Cesar Sosa-Celis in the leg.

The officers claimed that Sosa-Celis and another Venezuelan immigrant, Alfredo Aljorna, assaulted them with a broom and a shovel, which forced one of the officers to open fire in self-defense.

While the two men had been charged with assaulting the officers in the wake of the shooting, charges against them were abruptly dismissed on Thursday when prosecutors revealed that “newly discovered evidence in this matter is materially inconsistent with the allegations” made under oath by the officers.

Lyons said that the US Department of Justice (DOJ) is now investigating the two officers, who have been placed on administrative leave until the probe concludes.

US Homeland Security Secretary Kristi Noem last month defended the officers and parroted their claims about the shooting.

“What we saw last night in Minneapolis was an attempted murder of federal law enforcement,” Noem claimed. “Our officer was ambushed and attacked by three individuals who beat him with snow shovels and the handles of brooms. Fearing for his life, the officer fired a defensive shot.”

Noem has come under fire in recent weeks for lying about shootings involving federal immigration officials, such as when she falsely claimed that slain Minneapolis intensive care nurse Alex Pretti was aiming “to inflict maximum damage on individuals and to kill law enforcement” while filming officers’ activities.

In reality, video footage showed Pretti never drew his handgun during his deadly confrontation with federal immigration officers, while also clearly showing that officers disarmed him before they opened fire.

Aaron Reichlin-Melnick, senior fellow at the American Immigration Council, said that the newly uncovered evidence in Sosa-Celis’ case showed that the officer not only didn’t discharge his weapon in self-defense, but he “fired his gun through a closed door, striking the people inside.”

The Minnesota House of Representatives Democratic-Farmer-Labor (DFL) Caucus accused federal immigration agents of systematically lying to cover up unjustified shootings.

“They’re hiding evidence, stifling investigations, and fabricating information,” wrote the Minnesota House DFL on social media. “They’re lying to your face. We won’t let them get away with it—Minnesotans deserve justice.”

US Rep. Rob Menedez (D-NJ) said that lying appears to be endemic in the entire Trump administration.

“The Trump administration has consistently lied about ICE’s violent acts toward Americans and the abuses that this agency perpetuates every day,” he wrote. “They aren’t afraid to lie about members of Congress, and they certainly aren’t afraid to lie about any American they have killed, shot, or assaulted. This agency cannot continue to exist.”

“The American people didn’t vote for these scenes and you can’t continue to order them to not believe their lying eyes,” the New York Post editorial board wrote.

“The Trump administration spin on this simply isn’t believable.”

That’s what the editorial board of the right-wing Wall Street Journal wrote Sunday calling for a “pause” in Immigration and Customs Enforcement’s (ICE) anti-immigrant blitz following Saturday’s killing of 37-year-old intensive care nurse Alex Petti—who was disarmed before being shot by federal agents in Minneapolis—and top administration officials’ claims that the man who helped save US military veterans’ lives was a “domestic terrorist.”

The Journal‘s editors called Pretti’s killing “the worst incident to date in what is becoming a moral and political debacle” for President Donald Trump and his administration.

The Journal wasn’t alone. Other right-wing outlets owned by the Murdoch media empire, including the New York Post, published editorials calling for a suspension of Trump’s crackdown on undocumented immigrants, during which dozens of people have died in ICE custody and federal enforcers have killed two Americans. Even staunchly pro-Trump Fox News challenged administration officials over the shooting.

“It’s time to de-escalate in Minneapolis, Mr. President,” the Post‘s editorial board wrote Sunday.

“Not because you’re wrong to enforce immigration law, nor to go after fraudsters who’ve stolen billions in federal funds—but because these enforcement tactics won’t turn the tide, and instead are backfiring,” the editors clarified. “Swing voters—Hispanics and independents who turned to you at the last election—see US citizens dying at federal agents’ hands, and recoil in horror.”

“The hasty and misleading rhetoric coming out of the administration needs to stop,” the Post said. “And while Pretti was horribly misguided, there is no evidence he was a ‘terrorist’ intent on a ‘massacre’ of law enforcement.”

As they did with Renee Good, the 37-year-old mother and poet who was shot dead by an ICE agent in Minneapolis earlier this month, Trump and some of his senior officials accused Pretti of being a “domestic terrorist”—a move in line with the administration’s designation of left-wing activism as terrorism.

US Border Patrol Commander Gregory Bovino said that it looked like Pretti—who eyewitnesses said died while trying to help a woman who had been pepper-sprayed by ICE—“wanted to do maximum damage and massacre law enforcement.”

White House Deputy Chief of Staff Stephen Miller attempted to smear Pretti as an “assassin” who “tried to murder federal agents.”

Homeland Security Secretary Kristi Noem accused Pretti of “domestic terrorism.”

As the Wall Street Journal‘s editors put it, “Alex Pretti made a mistake, but he wasn’t a ‘domestic terrorist.’”

“Videos of an event aren’t always definitive, but this is how it looks to us,” they wrote. “Pretti attempted, foolishly, to assist a woman who had been pepper-sprayed by agents. Multiple agents then tackled Pretti, and he had a phone in one hand as he lay on the ground. An agent discovered a concealed gun on Pretti, and disarmed him. An agent then shot Pretti, and multiple shots followed.”

The Post editors concluded, “Mr. President, the American people didn’t vote for these scenes, and you can’t continue to order them to not believe their lying eyes.”

Meanwhile, more than 60 CEOs of Minnesota-based companies including Target, Best Buy, UnitedHealth, 3M, and General Mills published an open letter Sunday calling for “an immediate deescalation of tensions and for state, local, and federal officials to work together to find real solutions.”

Gun rights groups including the National Rifle Association have called for a full investigation of Pretti’s killing. The NRA pushed back against arguments that Pretti should not have brought a gun—which he was legally carrying—to a protestcalling such assertions “dangerous and wrong.”

“Responsible public voices should be awaiting a full investigation, not making generalizations and demonizing law-abiding citizens,” added the NRA, which was criticized for its initial silence following the killing of Philando Castile, a Black man who was legally carrying a gun when he was shot dead by police in front of his girlfriend and her 4-year-old daughter during a 2016 traffic stop in suburban Minneapolis.

Even Republican lawmakers who support Trump have expressed their dismay over Pretti’s killing, with Sen. Bill Cassidy of Louisiana calling the incident “incredibly disturbing.”

Chris Madel, an attorney who provided legal counsel to Jonathan Ross—the ICE agent who killed Good—was, until Monday, also a Republican candidate for Minnesota governor. However, Madel said that he dropped out of the race and implied that he would quit the GOP because he “cannot support the national Republicans’ stated retribution on the citizens of our state.”

“Nor can I count myself a member of a party that would do so,” he said.

“ United States citizens, particularly those of color, live in fear,” Madel continued. “United States citizens are carrying papers to prove their citizenship. That’s wrong.”

“At the end of the day, I have to look my daughters in the eye and tell them I believe I did what is right,” he added. “I am doing that today.”

“Mayor Frey is executing on the municipal laws passed by duly elected officials, by the people of Minneapolis,” said Ocasio-Cortez. “That is what it means to live in a democracy.”

US Homeland Security Secretary Kristi Noem said Sunday that President Donald Trump has “considered” invoking the Insurrection Act a day after Congresswoman Alexandria Ocasio-Cortez warned that Border Patrol agents’ killing of Alex Pretti had plunged the US into a “dangerous, dangerous moment” in which the White House appeared to be “laying the groundwork” to use the law to deploy the US military for domestic law enforcement.

Noem and other top White House officials, said Ocasio-Cortez (D-NY), have been suggesting that leaders like Minneapolis Mayor Jacob Frey and Minnesota Gov. Tim Walz—both Democrats who have demanded federal agents leave the city and state—are “breaking the law” by following local ordinances that protect immigrants and citizens from immigration enforcement.

Noem has claimed that the two leaders are “’inciting,’ that their resistance and difference from this administration, that their political difference in policy from this administration—she is equating disagreement with incitement,” the congresswoman told CNN Saturday.

She suggested the narrative appears aimed at convincing Americans that actions taken by local and state leaders could result in Trump invoking the Insurrection Act and sending the US military into cities, if he doesn’t agree with the leaders’ policies.

Like Trump and White House press secretary Karoline Leavitt have in recent days, Noem on Saturday accused the mayor and governor of “encouraging” violence against “our citizens and our law enforcement officers.”

“The Minnesota governor and the Minneapolis mayor need to take a long, hard look in the mirror,” Noem said. “They need to evaluate their rhetoric, their conversations, and their encouragement of such violence.”

She added that Walz “encouraged residents and citizens and violent rioters to resist.”

Over a week ago, Leavitt also accused Walz of “inciting the harassment” of US Immigration and Customs Enforcement (ICE) officers and said the governor should “pick up the phone and say that he will cooperate with the president and federal government in making Minnesota safer.”

Leavitt held up a photo of people she claimed were undocumented immigrants who had come into the country under the Biden administration and committed violent crimes, but analyses by the libertarian Cato Institute has shown nearly three-quarters of people booked into ICE detention in recent months had no criminal convictions.

The press secretary also accused Democratic governors and mayors of holding state and local law enforcement “hostage” with ordinances barring them from cooperating with ICE.

On CNN, Ocasio-Cortez said that while framing their attacks as though they are targeting Frey and Walz, Noem and Leavitt have actually been “taking issue with the people of Minneapolis and the people of Minnesota, who have duly elected their own elected officials to enact their will. They may not like it, but that is what the people of Minnesota and the people of Minneapolis want. They want people’s civil liberties and civil rights protected.”

“Mayor Frey is executing on the municipal laws passed by duly elected officials, by the people of Minneapolis,” said Ocasio-Cortez. “That is what it means to live in a democracy, and that is precisely what they are trying to threaten and undermine in this moment.”

On Fox News Sunday, Noem said that the question of whether to invoke the Insurrection Act, which would allow Trump to deploy the US military to American cities for domestic law enforcement purposes, is “up to the president” before repeating claims that Pretti was to blame for his own death.

The killing was caught on video by witnesses who saw him holding a cellphone as he tried to help a woman who’d been pushed to the ground by an agent, being pepper-sprayed, and then being thrown to the ground and surrounded by several officers, at least one of whom shot him 10 times after another agent had taken his legal firearm away.

Noem claimed, as she and other Trump officials did immediately after Pretti was killed, that he was “confronting” the officers and “impeding” their operations—assertions that are directly contradicted by videos of the incident.

Ocasio-Cortez said on CNN that following the fatal shooting, the administration has been “asking the American people to not believe their eyes, to not believe their ears, and to not believe what they are seeing right before them… They are asking you to instead hand over your belief to anything they say.”

‘Please Get the Truth Out,’ Alex Pretti’s Parents Plead as Trump Officials Baselessly Smear Shooting Victim

“Alex is clearly not holding a gun when attacked by Trump’s murdering and cowardly thugs,” said Michael and Susan Pretti.

Michael and Susan Pretti urged the press and the public to counter the Trump administration’s baseless claims about their son, Alex Pretti, after he was fatally shot by US Border Patrol agents on a street in Minneapolis and immediately—with no evidence—declared a “domestic terrorist” by top White House officials.

Pretti’s parents expressed heartbreak as well as anger over their son’s killing, which no federal officials contacted the family about, leaving them to learn he had been fatally shot from an Associated Press reporter who reached out to them.

“Alex was a kindhearted soul who cared deeply for his family and friends and also the American veterans whom he cared for as an ICU nurse at the Minneapolis VA hospital,” said the Pretti family. “Alex wanted to make a difference in this world. Unfortunately, he will not be with us to see his impact.”

They emphasized that Pretti acted as a “hero” in his final moments, moving to help a woman who had just been forcefully pushed to the ground by a federal agent.

“His last thought and act was to protect a woman,” they said before directly disputing claims by officials including White House Homeland Security Adviser Stephen Miller, Homeland Security Secretary Kristi Noem, and Border Patrol Commander Gregory Bovino, who have made claims that are contradicted by multiple videos of the shooting.

In addition to labeling Pretti a “domestic terrorist”—a claim likely stemming from a memo signed by Attorney General Pam Bondi, which claims that acts of domestic terrorism include “impeding” or “doxing” law enforcement officers even though filming federal agents is a constitutional right—officials have claimed he “approached US Border Patrol officers with a 9mm semi-automatic handgun” and wanted to inflict “maximum damage” on the agents.

Bovino on Saturday refused to answer a direct question about when Pretti approached the officers with a weapon; videos show him holding a phone, not the firearm he was legally permitted to carry in a holster, and approaching the woman who was pushed to the ground. The agents then pushed him to ground and surrounded him before one reached into the fray and took Pretti’s gun just before at least one officer fired roughly 10 shots, killing him. Despite the fact that Pretti had just been disarmed and was on the ground, officials have called the shooting “defensive.”

“The sickening lies told about our son by the administration are reprehensible and disgusting,” said Michael and Susan Pretti. “Alex is clearly not holding a gun when attacked by [President Donald] Trump’s murdering and cowardly thugs. He had his phone in his right hand and his empty left hand is raised above his head while trying to protect the woman ICE pushed down, all while being pepper sprayed.”

“Please get the truth out about our son,” the Pretti family concluded. “He was a good man.”

Pretti had no criminal record. He earned a bachelor’s degree in biology, society, and the environment from University of Minnesota in 2011 and worked as a research scientist before going back to school to become a registered nurse.

Pretti’s father added in comments to the AP that his son “was very upset with what was happening in Minneapolis and throughout the United States with ICE, as millions of other people are upset,” and had exercised his First Amendment right to demonstrate against the Trump administration’s mass deportation and detention campaign and an ICE agent’s killing of Renee Good earlier this month.

“He thought it was terrible, you know, kidnapping children, just grabbing people off the street,” said his father. “He cared about those people, and he knew it was wrong, so he did participate in protests.”

After the fatal shooting, the son of a deceased veteran whom Pretti had cared for at the VA hospital posted a video of him reading a “final salute” for his father.

“My father’s final words to me were, ‘Continue to fight the good fight,” wrote the man. “He would be honored in Alex’s sacrifice, and ashamed of this current administration. In my dad’s words I encourage you all to continue to ‘fight the good fight.’”

The AP reported that as of Saturday night, Pretti’s family still had not heard from federal officials about their son’s killing.

“The American people deserve to know how many of these violent insurrectionists have been given guns and badges by this administration.”

Congressman Jamie Raskin got right to the point in a letter to Attorney General Pam Bondi and Homeland Security Secretary Kristi Noem as he sought an answer to a question several Democratic lawmakers have raised in recent months regarding the Trump administration’s recruiting practices as it seeks to flood American communities with immigration officers.

“How many pardoned January 6th insurrectionists have been hired by your respective departments?” Raskin (D-Md.), ranking member of the House Judiciary Committee, asked the two officials.

The congressman wrote to Bondi and Noem as video evidence continues to mount of federal agents’ violent tactics in communities across the US following an Immigration and Customs Enforcement (ICE) agent’s fatal shooting of Minneapolis resident Renee Good last week.

The Department of Homeland Security (DHS), said Raskin, “seems to be courting pardoned January 6th insurrectionists.”

He pointed to “white nationalist ‘dog whistles’” it’s used in its recruitment campaigns that appear to target members of “extremist militias” like the Proud Boys, Oath Keepers, and Three Percenters.

Potential ICE recruits have been bombarded by messages from DHS calling on them to help “defend the homeland” and images like one of a white Uncle Sam caricature standing at a crossroads with signs pointing one way—labeled “INVASION” and “CULTURAL DECLINE”—and another, labeled “HOMELAND” and “LAW AND ORDER.” The image and caption appeared to be a reference to the white nationalist text Which Way, Western Man? by William Gayley Simpson.

The groups and militias apparently being targeted by the recruitment push coordinated with one another on January 6, 2021 as their members and leaders were among those who stormed the US Capitol in an effort to stop former President Joe Biden’s electoral victory from being certified.

One of President Donald Trump’s first actions after taking office last year was pardoning more than 1,500 people convicted of participating in the attempted insurrection, and dozens of them have been rearrested, charged, or sentenced for other crimes including child sexual assault, possession of child pornography, and domestic violence.

Other Democratic lawmakers have previously raised alarm about the lax hiring requirements DHS has put in place as it seeks to grow its ranks of ICE agents, with Sen. Dick Durbin (D-Ill.) noting in an October letter to Noem that in its push to hire more so-called “patriots,” ICE has “changed the age requirements for new recruits.”

“DHS announced that applicants now can apply at the age of 18 and there is no age cap. ICE also removed its Spanish-language requirement—shortening the training program by five weeks—and is pursuing additional ways to expedite training,” wrote Durbin. “The loosening of hiring standards and training requirements is unacceptable and will likely result in increased officer misconduct—similar to or worse than what occurred during a small surge in hiring US Customs and Border Protection officers in the early 2000s.”

On Monday, Raskin pointed out that ICE agents have been permitted to go to great lengths to hide their identities with masks as they’ve tackled people to the ground, “detained and battered multiple pregnant women,” threatened people and confiscated their cellphones for filming them—a protected activity under the First Amendment—and rammed open the door of a home in Minneapolis as they apparently began “door-to-door” operations.

“Unique among all law enforcement agencies and all branches of the armed services, ICE agents conceal their identities, wearing masks and removing names from their uniforms. Why is that? Why do National Guard members, state, county, and local police officers, and members of the Army, Navy, Air Force, and Marines all routinely work unmasked while ICE agents work masked?” wrote Raskin.

“Who is hiding behind these masks?” he continued. “How many of them were among the violent rioters who attacked the Capitol on January 6 and were convicted of their offenses? The American people deserve to know how many of these violent insurrectionists have been given guns and badges by this administration.”

He demanded the release of records related to the solicitation or hiring of anyone charged or investigated for participating in the January 6 attack.

Raskin’s letter was sent as independent journalist Ken Klippenstein reported on leaked documents showing that ICE and Border Patrol officials on the ground are struggling to cope with both staffing and legal compliance issues following Good’s killing.

“While Homeland Secretary Kristi Noem and others in the administration preen about justifying last week’s shooting and trumpet their war on ‘domestic terrorism,’ DHS is privately divided and hesitant about the latest deployments,” wrote Klippenstein, detailing efforts within the agency to find around 300 volunteers to deploy in Minneapolis, “in part due to opposition within the ranks.”

Following DHS’ aggressive recruiting push that appears to designed to appeal to extremist militias, “there might be some immature knuckleheads who think they are out there trying to capture Nicolás Maduro, but most field officers see a clear need for deescalation,” a high-ranking career official at DHS told Klippenstein. “There is genuine fear that indeed ICE’s heavy handedness and the rhetoric from Washington is more creating a condition where the officers’ lives are in danger rather than the other way around.”

Officials are reportedly pushing to rein in the agents whom the Trump administration has unleashed on communities including Minneapolis, where ICE agent Jonathan Ross shot Good while she was sitting in her car after she had reportedly been given conflicting orders by officers.

While Trump has suggested Good was to blame for her killing because she was “disrespectful” to the officers and videos have surfaced of agents attacking and threatening people for filming and observing them, Border Patrol Commander Greg Bovino sent a “legal refresher” to agents in the field, reminding them that protesters who use profanity, insults, and rude gestures are not breaking any laws.

Noncompliance with law enforcement and recordings of ICE agents are protected activities, the document reminds officers.

Sarah Saldaña, a former director of ICE, also recently said that DHS’ decision to frame its recruiting push as a “war effort” would inevitably result in a federal anti-immigration force that views itself as being at war with the communities it’s sent to.

DHS is promoting a viewpoint among recruits that “the quicker we get out there and run over people, the better off this country will be,” Saldaña told the Washington Postdays before Good was killed. “That mentality you’re fostering tends to inculcate in people a certain aggressiveness that may not be necessary in 85% of what you do.”

A DHS official who spoke to Klippenstein said that “the claim is that recruiting is up, but there is also dread that the gung-ho types that ICE and the Border Patrol are bringing in have a propensity towards confrontation and even violence.”
