Minnesota Prosecutor Probes ICE Arrest of Saint Paul Resident as Possible Abduction

Officials, said one observer, “are finally starting to call the terror ICE is inflicting on communities what it actually is: kidnapping.”

Prosecutors in Minnesota are investigating whether some of the most infamous images of the Trump administration’s immigration crackdown in the Twin Cities earlier this year actually captured a kidnapping, when US citizen ChongLy “Scott” Thao was filmed being taken from his home by federal agents in freezing temperatures, wearing only his underwear with a blanket wrapped around him.

Ramsey Country Attorney John Choi, whose jurisdiction covers Saint Paul, where Thao was arrested in January, said at a press conference Monday that he has requested information from the Department of Homeland Security about the man’s arrest.

“There are many facts we don’t know yet, but there’s one that we do know. And that is that Mr. Thao is and has been an American citizen. There’s not a dispute over that,” Sheriff Bob Fletcher said at the press conference.

The officials said they are investigating whether the agents could face criminal charges for kidnapping, burglary, and false imprisonment.

US Immigration and Customs Enforcement agents arrived without a warrant at the home Thao shares with his son, daughter-in-law, and four-year-old grandson on January 18 and forced their way in, brandishing their guns at the family as they handcuffed Thao.

They did not allow Thao’s daughter-in-law to get proof of his citizenship. The 56-year-old has been a US citizen for decades after his mother fled Laos in the 1970s.

“We believe there was no legitimate legal reason for the federal agents to enter that home, it was not supported by probable cause,” said Choi.

Without giving him a chance to get dressed, the agents then hauled Thao out of his home into the 14°F temperatures as his neighbors yelled and blew whistles at the officers, demanding his release.

They drove him around for nearly an hour before arriving at a remote area and demanding that he get out of the car and show his ID—which he hadn’t been allowed to bring. They determined he was a US citizen with no criminal record and drove him back home.

Fletcher said federal agents switched the license plates of the vehicle used during the arrest, violating Minnesota law and leaving authorities with no knowledge of the identities of the officers who arrested Thao.

“There’s no dispute that he was taken out of his house, forcibly taken out of his home, and driven around,” said Fletcher at the press conference. “Is that good law enforcement, to take an American citizen out of their home and drive them around aimlessly, trying to determine what they can tell them?’”

One observer said the officials “are finally starting to call the terror ICE is inflicting on communities what it actually is: kidnapping.”

“If regular people did this, they’d be in prison,” they said. “So why aren’t the agents?”

In keeping with the Trump administration’s response to widespread condemnation of its immigration crackdown and the conduct of its federal agents, DHS told The New York Times that Choi’s investigation into the arrest was “a political stunt to demonize ICE law enforcement.”

The agency has claimed the officers were looking for two convicted sex offenders, one of whom has reportedly been in state prison since 2024.

Choi said Monday that there is no evidence the federal agents had a judicial warrant to enter Thao’s home. The arrest took place days before a whistleblower group reported on an ICE memo which claimed that according to the DHS Office of the General Counsel, “the US Constitution, the Immigration and Nationality Act, and the immigration regulations do not prohibit relying on administrative warrants” in order to enter a home to make an arrest.

Legal experts have said the memo directly contradicts the Fourth Amendment, which prohibits unreasonable searches and seizures.

‘This Felt Like a Kidnapping Because It Was’: Family of Mahmoud Khalil Releases Arrest Video

Khalil’s wife said that “officers in plain clothes—who refused to show us a warrant, speak with our attorney, or even tell us their names—forced my husband into an unmarked car and took him away from me.”

The family of Mahmoud Khalil, a legal permanent resident of the United States now at risk of deportation because he helped lead pro-Palestinian protests at Columbia University last spring, on Friday released a video of his recent arrest by U.S. Department of Homeland Security agents in New York City, which has sparked legal battles and protests.

“You’re watching the most terrifying moment of my life,” Khalil’s wife, Noor, said in a statement about the two-minute video. “This felt like a kidnapping because it was: Officers in plain clothes—who refused to show us a warrant, speak with our attorney, or even tell us their names—forced my husband into an unmarked car and took him away from me.”

“Everyone should be alarmed and urgently calling for the freedom of Mahmoud and all other students under attack for their advocacy for Palestinian human rights.”

“They threatened to take me too, even though we were calm and fully cooperating. For the next 38 hours after this video, neither I or our lawyers knew where Mahmoud was being held. Now, he’s over 1,000 miles from home, still being wrongfully detained by U.S. immigration,” said Noor, whose husband is detained at a facility in Jena, Louisiana.

Noor, who is eight months pregnant, noted that “Mahmoud has repeatedly warned of growing threats from Columbia University and the U.S. government unjustly targeting students who want to see an end to Israel’s genocide in Gaza. Now, the Trump administration and DHS are targeting him, and other students too.”

“Mahmoud is clearly the first of many to be illegally repressed for their speech in support of Palestinian rights,” she added. “Everyone should be alarmed and urgently calling for the freedom of Mahmoud and all other students under attack for their advocacy for Palestinian human rights.”

Khalil, who finished his graduate studies at Columbia in December, is an Algerian citizen of Palestinian descent. He was living in the United States with a green card until his arrest on Saturday. In response to a filing by his legal team—which includes Amy Greer from Dratel & Lewis, the Center for Constitutional Rights (CCR), and the Creating Law Enforcement Accountability & Responsibility (CLEAR) project—a judge has temporarily blocked his deportation.

The ACLU and its New York arm have joined Khalil’s legal team, and his attorneys filed an amended petition and complaint on Thursday. NYCLU executive director Donna Lieberman said that with the new “filing, we are making it crystal clear that no president can arrest, detain, or deport anyone for disagreeing with the government. The Trump administration has selectively targeted Mr. Khalil, a student, husband, and father-to-be who has not been accused of a single crime, to send a message of just how far they will go to crack down on dissent.”

“But we at the NYCLU and ACLU won’t stand for it—under the Constitution, the Trump administration has no basis to continue this cruel weaponization of Mr. Khalil’s life,” Lieberman added. “The court must release Mr. Khalil immediately and let him go home to his family in New York, where he belongs. Ideas are not illegal, and dissent is not grounds for deportation.”

Samah Sisay of CCR reiterated those messages as the arrest video circulated on Friday, saying that “Mr. Khalil was taken by plainclothes DHS agents in front of his pregnant wife without any legal justification. Mr. Khalil must be freed because the government cannot use these coercive tactics to unlawfully suppress his First Amendment protected speech in support of Palestinian rights.”

Allies Demand Release of Dr. Hussam Abu Safiya From Notorious Israeli Prison

“Bombing of hospitals and kidnapping, torturing, and killing doctors and healthcare workers is illegal and immoral and a crime according to the Genocide Convention,” asserted Doctors for Humanity.

Human rights defenders in the global medical community and beyond are demanding Israel immediately release Dr. Hussam Abu Safiya, the director of Gaza’s obliterated Kamal Adwan Hospital, who was seized by Israeli troops on Saturday and is believed to be imprisoned at a notorious detention center where dozens of detainees have died and where torture, rape, and other abuses have been reported.

“We appeal to world leaders, to the global medical community, and to all who value humanity: Help us save our friend, our colleague, and a true healer,” Dr. Karameh Kuemmerle, a Boston-based pediatric neurologist and co-founder of Doctors Against Genocide, told Common Dreams on Monday.

“Put all kinds of pressure to ensure his release so he can return to his patients, who need him desperately, and to his family, who cannot endure this pain,” Kuemmerle added. “We demand a reality that respects life, respects human rights, and respects every man, woman, and child for humanity’s sake.”

Doctors for Humanity—a coalition of groups including Global Health Coalition, Doctors Against Genocide, and Union of Medical Care and Relief Organizations—said in a statement Monday, “We the medical community demand the immediate release of Dr. Abu Safiya and an immediate end to the bombing of hospitals and targeted kidnapping and killing of healthcare workers in Gaza.”

“Bombing of hospitals and kidnapping, torturing and killing doctors and healthcare workers is illegal and immoral and a crime according to the Genocide Convention,” Doctors for Humanity added.

Dr. Zaher Sahloul, president and co-founder the Illinois-based NGO MedGlobal, for whom Safiya works as lead Gaza physician, said over the weekend that “Dr. Abu Safiya has dedicated his life to protecting the health and lives of children in Gaza, providing care under conditions no medical professional should have to endure.”

“His arrest is not only unjust—it is a violation of international humanitarian law, which upholds the protection of medical personnel in conflict zones,” the group added. “We urgently call for the immediate and unconditional release of Dr. Abu Safiya.”

Dr. Yipeng Ge—who in November 2023 was suspended from his medical residency at the University of Ottawa for social media posts critical of Israel’s “settler-colonialism” and “apartheid upon Palestinian people”—called for Abu Safiya’s “immediate release,” as well as “protection of hospitals and medical workers in Gaza” and “an end to the genocide” there.

Amnesty International secretary-general Agnès Callamard hailed Abu Safiya as “the voice of Gaza’s decimated health sector,” who pleaded “for the protection of his hospital” while “working under inhumane conditions, including following the killing of his son” by an Israeli drone strike at the hospital gates earlier this year.

“We at Amnesty are extremely concerned over the fate and well-being of Dr. Hussam Abu Safiya,” Callamard said. “He must be released immediately and unconditionally.”

Recently released former detainees at the Sde Teiman prison in Israel’s Negev Desert said Abu Safiya is being held there, and that the Israeli security forces working there—some of whom stand accused of gang-raping a prisoner—are treating captured Palestinian doctors “really badly.”

“We are so worried, we haven’t been able to sleep for three days because we didn’t know until today where he is,” Idrees told the British newspaper.

Relatives of Abu Safiya toldCNN that “Sde Teiman is known for brutality and torture, we can’t imagine what our father is going through in that place and if he is well or not, warm or cold… hungry or in pain.”

Kuemmerle told Common Dreams: “What is striking about Dr. Abu Safiya is his extraordinary composure, kindness, and unwavering dedication, even in the face of unimaginable hardships. We have come to know his bravery, dedication, humane professionalism, and gentle manners. We are terrified for his fate, knowing all too well as Palestinians the horrors that await our doctors in these torture camps.”

Israel claims that Abu Safiya—who, despite the killing of his son and an injury caused by shrapnel from a November 23 Israeli attack on Kamal Adwan, refused to stop working at the hospital—is a suspected Hamas terrorist. That’s a common allegation made by Israeli officials, who also often claim that hospitals are used as Hamas command-and-control centers. These officials usually offer very little if any evidence to support their assertions.

“The lies that are being spread right now that [Abu Safiya] is really a Hamas colonel are lies to prevent what is happening right now, which is a global wave of outrage, and that global wave of outrage must grow so we, the global medical community, can stop the relentless attacks on healthcare workers and healthcare infrastructure,” Dr. Rupa Marya, a University of California, San Francisco professor of medicine who’s currently on paid suspension after questioning whether an Israeli student and likely Israel Defense Forces (IDF) veteran may have committed war crimes, told Common Dreams.

According to the Gaza Health Ministry, hundreds of healthcare workers have been detained and more than 1,000 have been killed since the October 7, 2023 Hamas-led attack on Israel. Critics accuse Israel of deliberately killing and wounding health workers.

The Geneva-based Euro-Mediterranean Human Rights Monitor on Saturday published the testimonies of witnesses to alleged IDF war crimes during the Kamal Adwan raid, including “deliberate killings, field executions, as well as sexual and physical assaults on women and girls from medical teams and displaced women in the area.”

Responding to Israeli attacks on hospitals and Abu Safiya’s detention, Rohan Talbot, director of advocacy and campaigns at London-based Medical Aid for Palestinians, said on the Bluesky social media platform Saturday that “our leaders must demand the immediate and safe release of Dr. Hussam Abu Safiya and all detained Gaza health workers.”

“Health workers are not a target,” he added, “and impunity for Israel’s destruction of Palestinian healthcare must end.”
