Texas Lawmakers Sound Alarm on ‘Torture, Killing, and Inhumane Treatment’ of Detainees in Fort Bliss ICE Facility

At least three inmates have died in the facility in just two months, including one who witnesses say was choked to death by guards.

A group of Texas legislators have delivered an urgent warning about the treatment of detainees in the country’s largest immigration detention camp, which sits on an Army base in El Paso.

“We have received numerous credible reports of torture, killing, and inhumane treatment of detained individuals at the Camp East Montana migrant detention facility, located within Fort Bliss,” said Rep. Ana-María Rodríguez Ramos (D-102), who joined 35 other Democrats in the Texas state House on Tuesday to demand an investigation into the facility.

Camp East Montana was constructed in August as part of the Trump administration’s effort to ramp up Immigration and Customs Enforcement’s (ICE) “mass deportation” of immigrants. The selection of Fort Bliss has historical precedent, having previously been used as a site for the internment of Japanese people during World War II.

Using a secretive contract undisclosed to the public, the Pentagon awarded roughly $1.2 billion to a private contractor in July to construct a sprawling tent city to hold around 5,000 people rounded up by ICE.

“Almost immediately upon its opening, detainees, their families, and legal watchdog organizations began bringing attention to conditions that were deemed unsuitable for detainees, even by internal standards set by Immigration and Customs Enforcement,” the legislators wrote in a letter to state Rep. Cole Hefner (R-5), who chairs the House Committee on Homeland Security, Public Safety, and Veterans Affairs.

During the camp’s first 50 days of operation, ICE inspections revealed that it had violated more than 60 federal detention standards. The report, compiled in September, was not released to the public, but was reported on by the Washington Postwhich spoke with dozens of detainees.

“On ICE’s webpage titled ‘Detention Management,’ it states that ‘detention is non-punitive,’” the legislators wrote Tuesday. “Yet, according to reporting by the Washington Post based on sworn statements from dozens of detainees, the facility, for months, was being run like a prison in a country without standards for oversight, health, or safety for the inmates.”

“There were complaints that the toilets and sinks didn’t work for the first few weeks after the facility’s opening last August. There were complaints logged that, for the first few weeks, the facility didn’t adequately feed detainees. They also complained about another violation of ICE standards: the lack of access to telephones for detainees to communicate with family and legal representation,” they continued.

Earlier this week, US Rep. Veronica Escobar (D-Texas), who visited the facility unannounced on Friday, disclosed that at least two cases of tuberculosis and 18 cases of Covid-19 had been identified at the facility.

“While the private corporation continues to pocket our tax dollars, it’s clear the conditions are only getting worse,” she said.

The state lawmakers also cited a letter sent by the ACLU, Human Rights Watch, and several other civil rights groups in December addressing “cases of illegal, extrajudicial attempts to deport detainees to Mexico.”

One inmate, a Cuban immigrant identified as “Benjamin,” said he was threatened by guards who attempted to make him sign a letter agreeing to be deported to Mexico.

“The guards told him that if he did not, they would handcuff him, put a bag over his head, and send him to Mexico. Benjamin refused to sign the document, stating that he was scared to go to Mexico, because he had heard that migrants are often kidnapped, robbed, or killed there,” the ACLU letter said.

The letter also provided several examples of inmates being subject to physical and sexual assault at the hands of officers.

“People detained at Fort Bliss report that officers have crushed detainees’ testicles with their fingers, slammed detained people to the ground, stomped on detained people and punched their faces, and beaten detained people even after they are cuffed and restrained,” it said.

The legislators also noted that three detainees have died in the facility in just two months.

On December 3, 48-year-old Guatemalan inmate Francisco Gaspar-Andrés was reported to have died of natural causes, namely liver and kidney failure, according to an ICE press release.

Since then, two other inmates have died. On January 14, 36-year-old Victor Manuel Diaz was found dead of an apparent suicide, though the cause of death remains under investigation.

Prior to that, the Department of Homeland Security reported that the death of another inmate, 55-year-old Geraldo Lunas Campos from Cuba, on January 3, was also a suicide.

However, witnesses have said they saw guards choking Lunas Campos and that he was heard saying, “I can’t breathe.” His death has since been ruled a homicide after an autopsy revealed the cause of death to have been “asphyxia due to neck and torso compression.”

The letter notes that while Lunas Campos was “convicted of heinous crimes,” including sexual contact with an 11-year-old, “he was not sentenced to death by a judge or jury—he was killed by someone responsible for his care, for unknown reasons or circumstances.”

“It is our responsibility as Texas legislators to ensure that we can trust that jails, prisons, and detention facilities in Texas operate to our high standards and expectations,” the lawmakers said. “We must learn more, investigate, and provide answers to the millions of Americans demanding the truth. We must also ensure this does not happen again in any federal detention facility.”

The call for an investigation comes as DHS plans to rapidly convert at least around two dozen warehouses into massive new detention centers across the country. At least three of these locations are planned for Texas. One of them, planned for the town of Hutchins outside Dallas, is expected to hold around 9,500 inmates.

The legislators said: “Human rights abuses, ignoring due process requirements, repeated violation of federal regulations, clear disrespect for the United States Constitution, and murder are unconscionable on any inch of American soil—but these crimes against real people are happening in Texas, and require proud Texans to stand up in defense of our Constitution and use our power to end this widespread abuse.”er to end this widespread abuse.”

‘Stupid, Criminal, and Horrifying’: Netanyahu Plan to Take Control of Entire Gaza Strip Condemned

“They’re talking about occupying areas that are packed with so many people,” said one Palestinian civilian. “If they do that, there will be incalculable killing.”

Ahead of a meeting with his security ministers, Israeli Prime Minister Benjamin Netanyahu confirmed once again Thursday that his government plans to take control of the entire Gaza Strip—”a direct assault on international law,” as one group said this week, and one that his own military leaders have opposed.

In an interview with Fox News, Netanyahu was asked whether his government aims to take over all of Gaza, 75% of which it now claims to control, as officials have stated this week.

“We intend to,” the prime minister said, saying his country would take control of the enclave “in order to assure our security, remove Hamas there, enable the population to be free of Gaza, and to pass it to civilian governance that is not Hamas and not anyone advocating the destruction of Israel.”

Netanyahu convened a security meeting after the interview, seeking approval for his plan to expand Israel’s offensive in Gaza to areas in the central part of the territory where hostages are believed to be held, which the Israel Defense Forces (IDF) have largely avoided since it began bombarding Gaza in October 2023.

The assault has forcibly displaced nearly the entire population of 2.1 million Palestinians, killed more than 61,000, and injured more than 150,000 as Israel’s near-total blockade has pushed the enclave toward famine and starved to death nearly 200 people, including at least 96 children.

The prime minister did not delve into specifics about the plan, but claimed Israel does not “want to govern” Gaza.

“We don’t want to be there as a governing body,” he said. “We want to hand it over to Arab forces.”

IDF Chief of Staff Eyal Zamir has expressed opposition to the proposal, and three military officials told The New York Times Thursday that the military would prefer a new cease-fire deal rather than intensifying fighting.

Cease-fire talks between Hamas and Israel have recently hit a deadlock.

Setting up a system of occupation in Gaza like the one Israel controls in the West Bank would take “up to five years of sustained combat,” officials told the Times.

Muhammad Shehada, a visiting fellow at the European Council on Foreign Relations, explained how Netanyahu and his Cabinet, including Finance Minister Bezalel Smotrich, likely plan to carry out “the final phase of the genocide” in Gaza, having recently set aside funds “for winning the war” in the enclave.

“Israel will move to annihilate the three remaining areas that haven’t been wiped out fully yet: Gaza City, Deir Al-Balah, and the central refugee camps (i.e. Nuseirat),” said Shehada. “Those three areas have been heavily bombed, invaded by the IDF, shelled nonstop but they have not been depopulated and fully razed to the ground like Rafah, Khan Younis, Jabaliya, Beit Hanoun, etc.”

Palestinian-American analyst Yousef Munayyer denounced Netanyahu’s stated plan as “stupid, criminal, and horrifying.”

Palestinians have expressed fears this week that the latest Israeli proposal would kill far more civilians in Gaza as the IDF moves into areas where hundreds of thousands of people have been forced to move.

“They’re talking about occupying areas that are packed with so many people,” Mukhlis al-Masri, a 34-year-old Palestinian who fled to Khan Younis from his home in northern Gaza, told the Times. “If they do that, there will be incalculable killing. The situation will be more dangerous than anyone can imagine.”

Mairav Zonszein, a senior analyst on Israel at the International Crisis Group, said Netanyahu’s comments on Thursday included “a slip, but a revealing one”: that Israel wants to “enable the population to be free of Gaza” following the IDF’s decimation of the enclave.

“Netanyahu’s threat to ‘take control’ of all of Gaza is like his threat in 2020 to annex the West Bank,” said Zonszein. “Israel already controls and destroyed most of Gaza, and already de facto annexed the West Bank. So while Palestinians will suffer more, Israeli strategy hasn’t changed one bit.”

Palestinian Envoy to ICJ: Israel Using Starvation as ‘Weapon of War’ in ‘Genocidal Campaign’

“Israel is starving, killing and displacing Palestinians while also targeting and blocking humanitarian organizations trying to save their lives,” said Palestinian envoy Ammar Hijazi.

With Israel’s “total and complete blockade” leaving people across Gaza “slowly dying” if they aren’t being “killed with bombs and bullets,” according to one United Nations official, Palestinian envoy Ammar Hijazi was among those who described the reality on the ground to the U.N.’s top court on Monday as the body considered Israel’s legal obligations in Palestine.

Ammar Hijazi, Palestinian ambassador to the Netherlands, warned the International Court of Justice (ICJ) that since October 2023, Israel’s blockade on humanitarian aid “has progressively turned into a total siege.”

“Israel is starving, killing, and displacing Palestinians, while also targeting and blocking humanitarian organizations trying to save their lives,” he said, accusing the Israeli military of waging a “genocidal campaign” in Gaza.

On March 2, for the second time since the Israel Defense Forces (IDF) began bombarding Gaza in retaliation for a Hamas-led attack in October 2023, Israel halted all humanitarian aid into the enclave. The total blockade was followed by Israel’s decision to end a cease-fire that has begun in January, conducting a bombing campaign that killed hundreds of Palestinians in its first day.

For nearly two months, food supplies have dwindled in Gaza, and the World Food Program announced last week that it had delivered its last remaining stocks of hot meals to food kitchens.

The siege has created conditions that are “incompatible with sustaining life or the continued existence of Palestinians in Gaza,” Hijazi said.

The ambassador noted that the ICJ hearing was taking place to consider whether Israel is violating international law.

“It is not about the number of aid trucks Israel is or is not allowing into the Occupied Palestinian Territories, especially Gaza,” said Hijazi. “It is about Israel destroying the fundamentals of life in Palestine while it blocks U.N. and other humanitarians from providing lifesaving aid to the population. It is about Israel unraveling fundamental principles of international law, including their obligations under the U.N. Charter.”

“Starvation is here,” Hijazi added. “Humanitarian aid is being used as a weapon of war.”

The hearing on Monday was the first of several that will take place at the ICJ over the next five days, following a resolution passed by the U.N. General Assembly last year calling on the court to consider Israel’s legal responsibilities after the government blocked the U.N. Relief and Works Agency for Palestine Refugees in the Near East (UNRWA) from operating in the Palestinian territories—cutting Palestinians off from the agency that has for years provided crucial food aid, cash assistance, and health services, among other necessities.

Elinor Hammarskjold, U.N. undersecretary-general for legal affairs, argued during the hearing that Israel’s ban on UNRWA is “inconsistent with Israel’s obligation under international law” and warned that Israel has an “overarching obligation to administer the territory for the benefit of the local population” and must “agree to and facilitate relief schemes.”

As the hearing was underway, medical sources in Gaza toldAl Jazeera that at least 36 people had been killed in Israeli attacks since dawn while eight out of 12 ambulances in southern Gaza were no longer operating due to a lack of fuel.

The Palestinian Civil Defense said its capacity to respond to residents in need will be increasingly reduced by the blockade, “threatening the lives of hundreds of thousands of citizens and displaced persons in shelters.”

“We hold the Israeli occupation responsible for the worsening suffering of our people in the Gaza Strip due to the ongoing war and the continued imposition of the blockade,” said the civil defense.

In addition to describing to the court the impact of Israel’s blockade, Hijazi spoke about the IDF’s attacks that have killed hundreds of aid workers, including nearly 300 UNRWA staff members and dozens of paramedics.

“These killings are deliberate, not accidental,” he said of the killing earlier this month of 15 paramedics who were found with bullet wounds in a mass grave, and whose vehicles were shown to be clearly marked in cellphone footage that was later released—despite Israeli claims that they had provoked suspicion by driving in the dark without headlights on.

One of the attorneys representing Palestine at the ICJ, Paul Reichler, said that “the inhumanity of this Israeli policy is compounded by its unlawful objective: to forever extinguish the right of the Palestinian people to self-determination.”

“In these circumstances, there can be no doubt that Israel is violating its obligations under international humanitarian law, including obligations under the Fourth Geneva Convention and customary international law,” said Reichler.

Blinne Ní Ghrálaigh, another of the international human rights lawyers who represented Palestine at the ICJ on Monday, cataloged just some of Israel’s recent displays of hostility to the rule of law, noting that Defense Minister Israel Katz said earlier this month that “Israel’s policy is clear: No humanitarian aid will enter Gaza,” and that the Israeli government is planning to annex 75 square kilometers of the southern Gaza city of Rafah as part of a so-called “buffer zone.”

Ní Ghrálaigh emphasized that “despite the extraordinary efforts of Palestinian journalists, who are themselves repeatedly targeted and killed, so much remains undocumented.”

“As stated by UNRWA’s commissioner-general, I quote, ‘I shudder to think of what will still be revealed about the horrors that have taken place in this narrow strip of land,'” she said.

Forty states and four international groups are scheduled to present in the upcoming ICJ hearings, which are separate from the genocide case filed at the court by South Africa. The ICJ said in January 2024 that Israel was required to take steps to protect Palestinians in Gaza from the risk of genocide and to provide humanitarian aid.

A ruling in the case that began Monday is expected to take several months to be announced.

MEDIA workers will gather outside the National Union of Journalists (NUJ) conference in Blackpool tomorrow to show support for their Palestinian colleagues and call on Israel to stop its troops targeting journalists. 

Union members from across Britain and Ireland will read out the names of the more than 200 media workers killed in Palestine in the past 18 months, highlighting that journalists have been the “eyes and ears of the world as the tragic events there have unfolded daily.”

They are also calling for greater solidarity with workers “still putting their lives on the line every day to bring the world the news” from Gaza.The demonstration will also highlight journalists’ opposition to the ban on international media from entering Gaza to bear witness to the events there, “which is contributing to the suppression of information about what is happening.”
