Exclusive: Former home secretary was told proscribing Palestine Action within six months of key Filton hearing could prejudice the case but went ahead anyway.

Britain’s former home secretary Yvette Cooper was warned that proscribing Palestine Action could prejudice the trial of six activists but went ahead anyway, it can be revealed.

Internal documents seen by Declassified show the Crown Prosecution Service (CPS) advised Cooper not to proscribe Palestine Action within six months of any Filton hearings.

The Filton 24 are pro-Palestine activists accused of breaking into a factory owned by Elbit Systems, Israel’s largest arms firm, in Bristol in August 2024.

The CPS was concerned that proscribing Palestine Action within six months of the hearings would prejudice their right to a fair trial.

Yet Cooper went against this advice and announced the proscription of Palestine Action less than five months before the first of those trials began in November last year.

Last week, the Guardian also revealed that Cooper risked being in contempt of court by justifying the proscription of Palestine Action in a column published in the Observer.

In that article, Cooper said the charges against the defendants involved a “terrorism connection” and accused the group of “intimidation, violence, weapons, and serious injuries to individuals”.

Defence lawyers sought to argue in court that Cooper had committed an “abuse of process” by discussing details of the case that were under reporting restrictions.

Mr Justice Johnson dismissed that application despite acknowledging that Cooper was “specifically advised that going ahead with the article might prejudice these proceedings”.

Taken together, the revelations suggest Cooper prioritised securing and justifying the proscription of Palestine Action over respecting due process.

The Home Office was approached for comment.

[Guardian] Exclusive: Then-home secretary justified proscription of group in newspaper column despite advice it might unfairly impact trial of six activists

Yvette Cooper wrote a newspaper column about Palestine Action despite prosecutors warning it could prejudice criminal proceedings against six activists from the group, it can be revealed.

The then-home secretary wrote the column justifying Palestine Action’s proscription even though the Crown Prosecution Service advised it might unfairly impact a trial concerning a 2024 break-in at an Israeli arms manufacturer’s factory.

After a retrial, four of the defendants were convicted last week in relation to the raid on the Elbit Systems UK site near Bristol. It can now be reported that defence lawyers sought to halt the proceedings for alleged abuse of process, claiming Cooper’s column for the Observer was “an egregious example of contemptuous reporting which directly interferes with the court process”.

The article, on 17 August, said that charges against Palestine Action activists included a “terrorism connection” and also referred to violence, intimidation and “disturbing information” about future attacks.

Rajiv Menon KC faced proceedings which his chambers said were unprecedented in English legal history

A leading human rights barrister has won his appeal against contempt of court proceedings, which were levelled at him for a closing speech in the trial of Palestine Action activists. 

The court of appeal’s ruling on Tuesday in the case of Rajiv Menon KC comes as it has also emerged that four of the defendants found guilty in a retrial can be sentenced as terrorists.

Three court of appeal judges found that the trial judge, Mr Justice Johnson, “had no jurisdiction” to refer the case against Menon to the High Court. 

Campaign group Defend Our Juries (DoJ) said: “Rajiv Menon KC did what every defence barrister should be free to do – in discharging his duty to his client: he told a jury the truth about their own rights.”

“The fact that contempt of court proceedings were even brought against a barrister for his closing speech – for the first time in British legal history – should deeply concern everyone who cares about the rule of law,” the group added.

Menon had been accused of violating Johnson’s orders in the first trial of six activists who broke into an Israeli-owned arms factory near Bristol in 2024 at the height of the Gaza genocide.

He barred the lawyers from inviting the jury to disregard the court’s ruling of law or to acquit the defendants on the basis of conscience, known as the principle of jury equity.

My understanding is that I am unable to mention many issues contained in this article due to secret court orders: UK judge Gags Palestine Action Defendants to Secure ‘Terror’ Stitch-Up so I won’t do that. What I will say is that the UK government and state has gone to considerable lengths to restrict the rights of Palestine Action defendants and supporters of Palestine Action persecuted for holding signs.

Defence barristers walk away from the trial of 6 Filton defendants following secret judicial rulings

At Woolwich Crown Court, there has been a shocking development in the Filton case, five of the six defence barristers have left the trial following judicial rulings which cannot be reported until the end of the trial.

A spokesperson for Defend Our Juries said today:

“In recent years we have seen judicial rulings that banned climate campaigners from saying the words ‘fuel poverty’ and ‘climate change’ in their trials. 

Today we understand a judicial ruling has been given that goes even further, and as a response the legal professionals representing five of the six defendants on trial in the Filton case have no choice but to leave the trial because they have been left with literally nothing they can say in closing arguments.

We should all be alarmed to hear that the legal process has been so corrupted that, today we have lawyers in the UK walking away from a trial because it is impossible for them to do their job of defending their clients.”

The trial of the first six defendants from the group known as the ‘Filton24’ has reached the stage of closing arguments. Five of the six defendants will now be giving their own closing speeches as they have no legal representation.

This is a retrial on charges of criminal damage, after the 6 Filton defendants were acquitted in February 2026 by a jury for the charges of aggravated burglary and violent disorder. The case relates to an action against Elbit’s weapons ‘research and development’ hub in Filton, Bristol, in which they are accused of destroying Israeli quadcopter drones.
