A US federal judge issued a temporary restraining order on October 9, blocking the Trump administration’s deployment of hundreds of National Guard troops to Chicago. Hundreds were already stationed in the midwestern city at the time of this ruling. This comes days after a separate judge blocked the deployment of the National Guard to Portland, Oregon.
Currently, there are around 500 National Guard troops in the greater Chicago area, 2,400 in Washington, DC, and 100 still in Los Angeles down from a peak of 4,700 in June.
With the support of the Governor of Tennessee, the state’s National Guard troops are set to begin patrolling the city of Memphis. Unlike Chicago, Los Angeles, and Portland, Tennessee’s Republican governor Bill Lee is supportive of Trump’s federal takeover efforts and therefore is sending troops from his own state to Memphis – thus eliminating the legal obstacles Trump has faced in other states.
Chicago’s Mayor Brandon Johnson called the judge’s order a “win for the people of Chicago and the rule of law.” The previous day, Trump called for the jailing of both Johnson and Illinois Governor JB Pritzker for “failing to protect Ice Officers”. But Johnson asserted that, as protests against violent ICE raids continue in Chicago, that there is “no rebellion,” there are “just good people standing up for what is right.”
Federal troops blocked in Portland
Trump announced the deployment of federal troops to Portland on September 27, characterizing the West Coast city as “war ravaged” and claiming that ICE facilities were under attack by “Antifa, and other domestic terrorists.”
According to federal judge Karin Immergut, who was appointed by Trump during his first term, there is “substantial evidence that the protests at the Portland ICE facility were not significantly violent or disruptive in the days – or even weeks – leading up to the President’s directive ordering the deployment of troops to Oregon.”
Top Trump adviser Stephen Miller described Immergut’s ruling as a “legal insurrection.”
On September 22, Trump announced that he was declaring “Antifa” a domestic terrorist organization, despite the fact that Antifa is a decentralized movement with no central organization attached.
Amid attempts by the Trump administration to militarize the city, Portland residents have continued to protest. Demonstrations continued against ICE, including a march to the ICE facility in Portland in the early afternoon of Saturday, October 4 – which was attacked by federal agents deploying tear gas, smoke canisters, and pepper balls at protesters. Protesters outside the ICE facility also experienced similar brutal crowd control tactics by federal agents once again that evening – including tear gas, flash-bang grenades, and pepper balls – despite no clear provocation by demonstrators.
Portland veterans urge National Guard members to disobey
On October 6, dozens of veterans, some with anti-war veteran group About Face, held a press conference, with some speakers and signage urging National Guard members to disobey Trump’s orders. Several signs read “Trump is the real enemy within,” referencing the President’s previous statements claiming that he is sending troops to so-called “Democrat-run” cities to protect from “invasion from within”. Other signs read: “Veterans say: Duty to disobey”, “No war in Portland”, and “Guard, go home.”
“Trump is signaling in very clear terms he wants to go to war in American cities,” said Portland City Councilor Mitch Green, an Army veteran who served in the US invasion of Afghanistan, at the press conference. “He said he wants to use Portland as a training ground and that soldiers should do ‘whatever they want’ to protesters. While it’s unclear what the role of the National Guard will be, these threats are as serious as anything in American history. The oath we took as soldiers absolutely comes with an asterisk, and this is it.”

“This administration is targeting our state for retribution,” said Rep. Chellie Pingree, “all because our elected officials are standing up for the rule of law.”
The Trump administration on Tuesday appeared to step up its clash with Maine’s Democratic-led government over the state’s support for transgender women who play on women’s sports teams, as the University of Maine announced $100 million in its federal funding had been halted.
The university system said the U.S. Department of Agriculture (USDA) funding was being temporarily paused while the Trump administration investigates whether the University of Maine System (UMS) is violating Title VI or Title IX of the Civil Rights Act, which prohibit discrimination based on race or national origin and sex, respectively.
The USDA began a review of UMS compliance with the Civil Rights Act in February, a day after Gov. Janet Mills told President Donald Trump at a White House event that she was prepared to defend Maine’s decision to continue allowing transgender students to play on girl’s and women’s sports teams.
The National Collegiate Athletic Association (NCAA) updated its policies to comply with Trump’s executive order requiring the Department of Education to notify school districts that allowing transgender students to compete on women’s teams violates Title IX.
“If all of their funding was removed from USDA, that would have a really big impact on farmers on the ground here.”
But Mills told Trump that she will “comply with state and federal law.” In 2021, Maine’s state laws were updated to allow student athletes to compete on teams that correspond to their identity as long as there are no safety concerns.
Since the USDA opened its review of UMS policies, the university system has confirmed to the department that its athletic programs are in compliance with state and federal laws and that its schools that are part of the NCAA are following the association’s recently updated policies.
UMS said in a statement Tuesday that after notifying the USDA of its compliance on February 26, it did not hear from the department until the notice of the funding pause was sent on March 10, with the USDA accusing the university of “blatant disregard” for Trump’s executive order.
The agency said last month that UMS “receives over $100 million in USDA funding.”
UMS said Tuesday that it has received funding from federal agencies including the USDA since its founding in 1865, with the USDA awarding $29.78 million in 2024 for research benefiting the largely rural state.
UMS has used its current USDA funding to invest in numerous projects, including but not limited to:
Research on per- and polyfluoroalkyl substances (PFAS), also known as forever chemicals, on Maine farms;
The development of sustainable packaging materials derived from Maine’s forests;
Research on the health and sustainability of the state’s lobster fishery;
Support for 4-H youth leadership and STEM skill development programs serving tens of thousands of Maine youth annually; and
Education and outreach to Maine livestock farmers on farm biosecurity and disease outbreak preparedness.

U.S. Rep. Chellie Pingree (D-Maine) denounced the USDA’s “vindictive” funding pause, noting that the agency “shared no findings, and offered no opportunity for a hearing.”
“It fails to provide any sort of timeline or opportunities for recourse,” she said in a statement posted on social media. “Let’s be clear about what this latest funding freeze will do: It will hurt farmers and rural Mainers, it will halt critically-needed research innovation, and it will slash educational opportunities for students throughout Maine. Once again, it appears as though this administration is targeting our state for retribution—all because our elected officials are standing up for the rule of law.”

UN Special Rapporteur Francesca Albanese’s talks have faced intense state pressure across Europe, with Germany at the forefront
Talks by UN Special Rapporteur on the occupied Palestinian territories Francesca Albanese in Europe continue to face fierce pressure. Following the withdrawal of an invitation by some Dutch parliamentarians, German authorities have gone to great lengths to obstruct events where Albanese was scheduled to speak. Two German universities canceled events that had already been announced and had garnered widespread interest. However, activists secured alternative venues, ensuring Albanese could still present the results of her work.
Yet even non-institutional venues were not spared from pressure. The publisher of Junge Welt, which stepped in to host the event “Reclaiming the Discourse: Palestine, Justice, and Truth“ after it was cast out from its original location, found itself facing nearly 100 police officers. Inside the hall, around 200 attendees gathered to hear Albanese speak. Despite protests, the police remained stationed at the venue throughout the event, serving as a clear reminder of the dire state of free expression in Germany. While the hosts are considering legal action against the police, such repression is expected to persist, as left-wing activists remain under surveillance and students organizing Palestine solidarity events at universities face persecution.
Organizations hosting Albanese, including the political platform DiEM25, have described these pressures as “a direct assault on the rule of law and the core principles of democracy.” Similarly, the Sahra Wagenknecht Alliance – Reason and Justice, along with members of the left party Die Linke, condemned the suppression of academic freedom and the silencing of discussions on Palestine soon after the news of the cancellations.
According to Albanese, Germany is the first country she has visited recently where universities have capitulated to pressure and canceled her speeches. “This gives me a sense of the state of the debate in this country,” she told attendees of Reclaiming the Discourse. Throughout the discussion, the UN Special Rapporteur emphasized the lengths to which many European governments are willing to go to suppress debates on Palestine—Germany, in particular, leading the charge. Despite the authorities’ repressive actions, she insisted that “it’s not a crime to talk about Germany’s implications and responsibilities vis-à-vis what’s happening in Palestine.”
She also urged participants to reject fear and organize against the climate of repression surrounding discussions on Palestine in Europe, describing it as an atmosphere lacking oxygen. “It’s no longer [just] about Palestine,” she continued. “When I see police officers in Europe using the stick against people standing against injustice, when I see Jewish people in this country being lectured about what antisemitism is—I say something has gone wrong.”
“I wouldn’t feel comfortable living in a country where you cannot talk about a people who are being genocided,” she added.
In their attempts to silence Albanese, Zionist groups and other right-wing organizations have attempted to smear her as antisemitic. Some have fallen for this ruse, but many more continue to stand by her and amplify her work. While audience members noted that university staff largely failed to publicly support her or defend academic freedom following the cancellations, Albanese pointed to the legal and academic experts, including in the Global South, who have spoken out, urging institutions to refuse such repression.
“While our politicians and universities fail to show respect for a UN Special Rapporteur, we, as international lawyers, fail a colleague and a luminary in these dark times by not standing up for her against false and unfounded accusations,” wrote public and international economic law expert and professor Isabel Feichtner. “Most of all, however, we fail our students, broader society, and the very idea of human rights, which—if they are to have any meaning—must serve the powerless.”

The Trump administration’s defiance of court orders that threaten to hamper the president and unelected billionaire Elon Musk’s assault on federal agencies and basic rights has legal experts and other observers warning of a perilous new phase in the United States’ rolling constitutional crisis.
On Monday, the Revolving Door Project (RDP) launched an effort to track the Trump administration’s refusal to comply with orders from the federal judiciary and detail the impact that obstinance is having across the country.
The watchdog group pointed to several specific examples, including the Environmental Protection Agency’s refusal to “disperse already-awarded grants funded by the Inflation Reduction Act, in apparent defiance of” federal judges’ orders against the Trump administration’s sweeping funding freeze.
“NOTHING is more important than civil society pressuring judges to have a spine in the face of Musk and Trump’s intransigence,” Jeff Hauser, RDP’s executive director, wrote on social media late Monday. “Judicial orders must be enforced!”
Journalists Judd Legum and Noel Sims highlighted another example on Tuesday, noting that the administration is “prohibiting National Institutes of Health (NIH) staff from issuing virtually all grant funding” despite two federal court injunctions against the freeze.
David Super, a professor at Georgetown University Law Center, told Legum and Sims that the Trump administration is “in contempt of court,” calling the continued freeze on NIH grants “completely unlawful.”
“The administration cannot choose which law it will follow or ignore. These are not partisan or political issues. These are rule of law and process issues. We cannot afford to remain silent.”
Super is among a growing number of legal experts sounding the alarm about the nation’s descent into a full-blown constitutional emergency.
“We are in the midst of a constitutional crisis right now,” Erwin Chemerinsky, a constitutional law expert and dean of the University of California, Berkeley School of Law, told The New York Times late last week. “There have been so many unconstitutional and illegal actions in the first 18 days of the Trump presidency. We never have seen anything like this.”
“Systematic unconstitutional and illegal acts create a constitutional crisis,” Chemerinsky added.
Both President Donald Trump and Vice President JD Vance have levied criticism at the federal judiciary in recent days as it has put up roadblocks that have hindered the new administration’s ability to lawlessly impose its will.
“Certain activists and highly political judges want us to slow down, or stop,” Trump wrote in a social media post early Tuesday, just days after Musk floated allowing “elected bodies” to terminate “the worst 1% of appointed judges.”
In a statement on Monday, American Bar Association (ABA) president William Bay noted that “in the last 21 days, more than a dozen lawsuits have been filed alleging that the administration’s actions violate the rule of law and are contrary to the Constitution or laws of the United States.”
“The administration cannot choose which law it will follow or ignore,” said Bay. “These are not partisan or political issues. These are rule of law and process issues. We cannot afford to remain silent. We must stand up for the values we hold dear. The ABA will do its part and act to protect the rule of law.”
“We urge every attorney to join us and insist that our government, a government of the people, follow the law,” he added. “It is part of the oath we took when we became lawyers. Whatever your political party or your views, change must be made in the right way. Americans expect no less.”
