Morning Star Editorial: … a mass campaign to overturn the Palestine Action ban

THE Court of Appeal decision to uphold the government’s absurd ban on Palestine Action as a “terrorist” group shows the need for a political revolt against the decree.

The definition of terrorism is being stretched to include any criminal damage to property done with a political motive, as we saw with Friday’s sentencing of the Filton Four. There, Mr Justice Johnson cited defendants’ aim to “influence the government” as evidence in favour of treating their attack on an arms factory belonging to Israeli firm Elbit Systems as a terrorist act.

The Court of Appeal is similarly sweeping. “The whole premise of Palestine Action is to cause damage to property,” it charges, before adding: “At no stage has Palestine Action suggested that its terrorist activities were either a mistake or an aberration.” “Damage to property” has by sleight of hand become “terrorist activities.”

Judges’ reference to the Suffragettes, in order to contrast their direct action to Palestine Action’s so-called terrorism, is again misleading; they state that the latter has “caused injury as well as property damage” (so did some Suffragette activities) and that its use of “secret cells to avoid … detection and prosecution” adds to the case for it being terrorist.

Elbit’s production of weapons used in a genocide against the Palestinians is described as “lawful business” despite the cases against Israel and Israeli leaders at the International Court of Justice and International Criminal Court. And speculation about future activities is given as much weight as anything that has actually been done (“The future threats and risks posed to third party individuals and property by Palestine Action are perhaps the most important factors … the home secretary is in the best position to assess those future threats and risks”).

All this simply shows that the courts are not a defence against authoritarian government.

Denying that the ban has had a chilling effect on freedom of protest, when police have arrested thousands of people for sitting down in public holding placards, is ludicrous; so is trusting ministers to tell the truth about groups they want to ban (the home secretary who pushed the ban through, Yvette Cooper, prepared the ground with baseless smears that Palestine Action might be funded by Iran).

Evidence-free froth about links to foreign states is doubly dangerous: it provides an excuse to suppress dissenting voices at home and raises international tensions when the risk of world war is again real, thanks in no small degree to the belligerence of our own government and its trigger-happy allies.

If the government cannot be turned from its repressive path judicially then this needs to happen politically. Even if Palestine Action can appeal to the Supreme Court, that won’t stop plans to give police powers to ban marches based on their “cumulative impact” or the prosecutions of peace movement leaders like Ben Jamal and Chris Nineham. We need a mass movement that forces ministers to back down.

Keir Starmer objects to criticism of the IDF. He asks how could anyone object to them starving people to death, forced marches like the Nazis did, bombing Gaza's hospitals and universities, mass-murdering journalists, healthworkers and starving people queuing for food, killing and raping prisoners and murdering children. He calls for people to stop obstructing his genocide for Israel.

Judges’ references to the Suffragettes are ridiculous. Are they suggesting that the Suffragettes didn’t plot secretly to kidnap cabinet ministers and subject them to forced feeding? Is it suggested that they published all their plans and intentions publicly so that here was no element of surprise? Are they saying that Suffragette bombers and arsonists campaigning for suffrage were not terrorists while Palestine Action opposing genocide are?

I consider that a horse crop whip only stings very briefly by the way, there is the crack of a whip but hardly painful and extremely short-lived, doesn’t leave any marks.

Jury mulls case of four protesters who raided Wolverhampton arms factory said to produce “military aircraft parts for Israel”

A jury at Birmingham crown court is deliberating whether four pro-Palestine activists committed criminal damage at an arms factory in Wolverhampton.

Defendants Iain Evans, Hisham Alkhamesi, Frank Sherman, and Hana Yun-Stevens believed the factory, used by arms firm Moog, supplied weaponry to Israel.

They climbed onto the roof in August 2025, smashed equipment and unveiled a banner saying “Free Palestine” while wearing T-shirts with the names of Palestinians killed in Israeli airstrikes.

Jurors were unable to reach a verdict this week and have been discharged until Tuesday.

Sherman, 23, told the jury they would always believe disrupting the factory was “not criminal” and that any repercussions they may face could not “compare to how I would feel if I had not taken action”.

Lawyers for the other defendants reminded the jury of its powers – referencing the Magna Carta and the Bushell case, a landmark ruling from 1670 which established the independence of juries.

They also mentioned how the suffragettes “did a bit of smashing themselves”.

CLIMATE campaigners dressed as suffragettes outside the National Gallery today against anti-protest laws ahead of International Women’s Day.

The Fossil Free London group’s action took place ahead of International Women’s Day on Sunday, drawing attention to the tightening of anti-protest laws.

They held placards highlighting comparisons between the jail terms received by climate protesters and those handed to militant suffragettes in the early 20th century.

Just Stop Oil activists Phoebe Plummer and Anna Holland were sentenced to a combined 44 months in prison for throwing soup in the National Gallery in 2022.

They caused minor damage to the frame of Van Gogh’s Sunflowers painting.

Their action recalled the famous National Gallery protest by militant suffragette Mary Richardson, arrested for slashing Velazquez’s Rokeby Venus.

She was sentenced to a considerably shorter time of six months in prison.

Charlotte Head, who is accused of taking part in a break-in at Israeli defence firm, is called a ‘remarkable woman’ by her barrister

… Charlotte Head, 29, is on trial at Woolwich crown court, south-east London, accused of being involved in a “meticulously organised” protest at the Elbit Systems factory in Filton, near Bristol, on 6 August 2024.

… On Thursday in closing submissions, Head’s barrister, Rajiv Menon KC, detailed his client’s years of activism, including her work with refugees in Calais. He said the suffragettes were celebrated publicly for their heroism but in their time were accused of being “a threat to the social order” and “unladylike, feral, aggressive, violent” by MPs and in the mainstream press.

“The reality, of course, is very different,” Menon told the court. “The suffragettes were remarkable women from all walks of life united in their hope, their despair, their defiance and their dedication.

“Charlotte Head is also a remarkable woman and I say that without any reservation. This is not something that lawyers defending clients in criminal trials often say … we are taught to avoid the personal. But it must be said in this case, not only because it is true but also because it is relevant.”

Menon described Elbit Systems, of which Elbit Systems UK is a subsidiary, as a “dreadful company” that “has played a critical role in the killing of tens of thousands of Palestinians” but is “wined and dined” in the corridors of power.

Morning Star Editorial: Zarah Sultana: if Palestine Action are banned as ‘terrorists’ who will be next?

dizzy: I hope that Morning Star will excuse me quoting this article in it’s entirety.

Zarah Sultana speaking after a march organised by the Palestine Solidarity Campaign, from Russell Square to Whitehall in central London, June 21, 2025
This week, MPs shamefully approved the proscription of Palestine Action. Several challenged the move in the Commons. Zarah Sultana, Independent MP for Coventry South, gave an outstanding speech in condemnation. Because of the exceptional gravity of the issue, we reproduce her speech, lightly edited, here.

TWENTY-ONE years ago, a human rights barrister … defended an activist who broke into RAF Fairford trying to disable a bomber to prevent war crimes in Iraq. That became a landmark case in lawful, non-violent direct action against an illegal war. That barrister is now our Prime Minister, Keir Starmer KC. He argued that it was not terrorism, but conscience.

Fast-forward to June 20 2025: two Palestine Action activists entered RAF Brize Norton and sprayed red paint — red paint, not fire — on aircraft linked to surveillance flights over Gaza. Instead of prosecuting them for criminal damage, the Home Secretary is using the Terrorism Act 2000 to proscribe Palestine Action as a terrorist group.

This is an unprecedented and dangerous overreach of the state. Never before in Britain has it been a crime to simply support a group.

Palestine Action’s real crime is shutting down Elbit Systems sites that arm the Israeli military; its true offence is being audacious enough to expose the blood-soaked ties between this government and the genocidal Israeli apartheid state and its war machine.

Let us be clear: to equate a spray can of paint with a suicide bomb is not just absurd; it is grotesque. It is a deliberate distortion of the law to chill dissent, criminalise solidarity and suppress the truth.

Amnesty International, Liberty, over 266 senior lawyers and UN special rapporteurs have all opposed these draconian measures. Under this order, anyone expressing moral support for a proscribed group could face 14 years in prison. That includes wearing a badge, wearing a T-shirt, sharing a post or calling for de-proscription.

And journalists have no exemption either: there is no legal protection for reporting favourably, even factually, about Palestine Action.

Let us not forget what is happening in Gaza, where the real crimes are being ignored: hospitals bombed, children starved, and tens of thousands of people killed. Palestinian children now suffer more amputations per capita than children anywhere else on Earth.

Israel is on trial for genocide at the International Court of Justice, and the Israeli Prime Minister faces an International Criminal Court arrest warrant, yet the government’s response is to criminalise solidarity and to continue exporting lethal F-35 jets that are decimating Gaza.

We also have to understand the history of this country and what built our democracy: the tradition of civil disobedience that includes the suffragettes, without whom I would not have the vote, let alone the privilege of being here as an MP.

Even those who oppose Palestine Action’s tactics must recognise the vast gulf between criminal damage and terrorism. If this order passes, what and who is next — climate protesters, striking workers, feminists in the street?

Already we have seen a wider crackdown on our civil liberties — musicians censored, journalists arrested, and demonstrators, including MPs sitting here, harassed — and now this government want to use anti-terror laws to make peaceful protest itself a crime. If our democratic institutions functioned as they should, none of this would be necessary.

If this proscription passes, we have to understand that no campaign will be safe tomorrow. We have to recognise that this will go down as a dark day in our country’s history … People will ask, “Which side were you on?” and I stand with the millions of people who oppose genocide, because I am one of them. I oppose the blood-soaked hands of this government trying to silence us. So I say this loudly and proudly: we are all Palestine…

Deputy Speaker intervened here with “Order!”
