‘Awful News for Due Process’ as Court Backs Trump’s Mass Immigrant Detention

A divided federal appellate panel ruled Friday in favor of the Trump administration’s policy of locking up most undocumented immigrants without bond, a decision that legal experts called a serious blow to due process.

A three-judge panel of the right-wing 5th US Circuit Court of Appeals in New Orleans ruled 2-1 that President Donald Trump’s reversal of three decades of practice by previous administrations is legally sound under the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (IIRIRA). The ruling reverses two lower court orders.

“The text [of the IIRIRA] says what it says, regardless of the decisions of prior administrations,” Judge Edith Jones—an appointee of former President Ronald Reagan—wrote for the majority. “That prior administrations decided to use less than their full enforcement authority… does not mean they lacked the authority to do more.”

Writing in dissent, Judge Dana M. Douglas, who was appointed by former President Joe Biden, asserted that “the Congress that passed IIRIRA would be surprised to learn it had also required the detention without bond of two million people. For almost 30 years there was no sign anyone thought it had done so, and nothing in the congressional record or the history of the statute’s enforcement suggests that it did.”

“Nonetheless, the government today asserts the authority and mandate to detain millions of noncitizens in the interior, some of them present here for decades, on the same terms as if they were apprehended at the border,” Douglas added. “No matter that this newly discovered mandate arrives without historical precedent, and in the teeth of one of the core distinctions of immigration law. The overwhelming majority elsewhere have recognized that the government’s position is totally unsupported.”

Past administration generally allowed unauthorized immigrants who had lived in the United States for years to attend bond hearings, at which they had a chance to argue before immigration judges that they posed no flight risk and should be permitted to contest their deportation without detention.

Mandatory detention by US Immigration and Customs Enforcement (ICE) was generally reserved for convicted criminals or people who recently entered the country illegally.

However, the Trump administration contends that anyone who entered the United States without authorization at any time can be detained pending deportation, with limited discretionary exceptions for humanitarian or public interest cases. As a result, immigrants who have lived in the US for years or even decades are being detained indefinitely, even if they have no criminal records.

According to a POLITICO analysis, more than 360 judges across the country—including dozens of Trump appointees—have rejected the administration’s interpretation of ICE’s detention power, while just 26 sided with the administration.

While US Attorney General Pam Bondi hailed Friday’s ruling as a “significant blow against activist judges who have been undermining our efforts to make America safe again at every turn,” some legal experts said the decision erodes constitutional rights.

“AWFUL news for due process,” American Immigration Council senior fellow Aaron Reichlin-Melnick said on social media in response to Friday’s ruling. “This decision will wipe out the availability of release through bond for tens of thousands of people detained in or transported to Texas, Louisiana, and Mississippi by ICE.”

While Friday’s ruling only applies to those three states, which fall under the 5th Circuit Court’s jurisdiction, there are numerous legal challenges to the administration’s detention policy in courts across the country.

Rep. Yassamin Ansari ripped the Justice Department’s “indefensible and horrifying disregard for the victims,” and stressed that “rich and powerful men continue to evade accountability for their heinous crimes.”

Congresswoman Yassamin Ansari on Sunday called for the impeachment of US Attorney General Pam Bondi after the Department of Justice published dozens of unredacted nude photos of young women or teenagers as part of its legally required release of files related to deceased sex offender Jeffrey Epstein.

The DOJ released the final batch of documents on Friday, well beyond the December 19 deadline established by the Epstein Files Transparency Act. Although President Donald Trump signed the law, his ties to the late billionaire and heavy redactions of previously released records have fueled concerns about the process.

While reviewing the more than 3 million pages published last week, New York Times journalists found “nearly 40 unredacted images” of “nude bodies and the faces of the people portrayed,” the newspaper reported. “The people in the photos appeared to be young, although it was unclear whether they were minors. Some of the images seemed to show Mr. Epstein’s private island, including a beach. Others were taken in bedrooms and other private spaces.”

The paper continued:

The Times notified the Justice Department on Saturday of nude images that journalists had encountered and flagged more of them on Sunday. A spokeswoman said that the department was “working around the clock to address any victim concerns, additional redactions of personally identifiable information, as well as any files that require further redactions under the act, to include images of a sexual nature.”

“Once proper redactions have been made, any responsive documents will repopulate online,” the spokeswoman said.

Officials have largely removed or redacted the images that the Times flagged for them. The images appeared to show at least seven different people, although the Times did not seek to identify them.

Flagging the report on social media late Sunday, Ansari (D-Ariz.) declared that “this is an indefensible and horrifying disregard for the victims by Trump’s US Department of Justice. They are still withholding the full Epstein Files, and rich and powerful men continue to evade accountability for their heinous crimes. Attorney General Pam Bondi should be impeached.”

Even before the nude photos were discovered, progressive Congresswoman Alexandria Ocasio-Cortez (D-NY) similarly called for Bondi’s impeachment on Friday, pointing to not only her DOJ’s handling of the Epstein files, but also its efforts to force Minnesota to turn over voter data and the arrest of journalists, including former CNN anchor Don Lemon.

Since Friday, survivors of Epstein’s abuse have also slammed the DOJ, with 18 of them saying in a joint statement that the latest release “is being sold as transparency, but what it actually does is expose survivors. Once again, survivors are having their names and identifying information exposed, while the men who abused us remain hidden and protected. That is outrageous.”

“As survivors, we should never be the ones named, scrutinized, and retraumatized while Epstein’s enablers continue to benefit from secrecy. This is a betrayal of the very people this process is supposed to serve,” they continued. “This is not over. We will not stop until the truth is fully revealed and every perpetrator is finally held accountable.”

CNN reported Monday that lawyers Brittany Henderson and Brad Edwards requested “immediate judicial intervention” by US Judges Richard Berman and Paul Engelmayer to address at least “thousands of redaction failures on behalf of nearly 100 individual survivors whose lives have been turned upside down by DOJ’s latest release.”

“There is no conceivable degree of institutional incompetence sufficient to explain the scale, consistency, and persistence of the failures that occurred—particularly where the sole task ordered by the court and repeatedly emphasized by DOJ was simple: Redact known victim names before publication,” the attorneys wrote.

While the DOJ didn’t reply to the outlet’s request for comment, Henderson said in a statement to CNN that “with every second that passes, additional harm is being caused to these women. They are scared, they are devastated, and they are begging for our government to protect them from further harm.”

Congressional Democrats on Saturday pressed US Attorney General Pam Bondi for answers regarding the apparent removal of a photo showing President Donald Trump surrounded by young female models from Friday’s Department of Justice release of files related to the late convicted child sex criminal Jeffrey Epstein.

Amid the heavily redacted documents in Friday’s DOJ release was a photo of a desk with an open drawer containing multiple photos of Trump, including one of him with Epstein and convicted child sex trafficker Ghislaine Maxwell and another of him with the models.

However, the photo—labeled EFTA00000468 in the DOJ’s Epstein Library—was no longer on the site as of Saturday morning.

Numerous critics have accused the Trump administration of a cover-up due to the DOJ’s failure to meet a Friday deadline to release all Epstein-related documents and heavy redactions—including documents of 100 pages or more that are completely blacked out—to many of the files.

Deputy Attorney General Todd Blanche responded to the criticism by claiming that “the only redactions being applied to the documents are those required by law—full stop.”

“Consistent with the statute and applicable laws, we are not redacting the names of individuals or politicians unless they are a victim,” he added.

Earlier this year, officials at the Federal Bureau of Investigation reportedly redacted Trump’s name from its file on Epstein, who was the president’s longtime former friend and who died in 2019 in a New York City jail cell under mysterious circumstances officially called suicide while facing federal child sex trafficking and conspiracy charges.

Trump has not been accused of any crimes in connection with Epstein.

House Oversight Committee Ranking Member Robert Garcia (D-Calif.) said during a Friday CNN interview that the DOJ only released about 10% of the full Epstein files.

The DOJ is breaking the law by not releasing the full Epstein files. This is not transparency. This is just more coverup by Donald Trump and Pam Bondi. They need to release all the files, NOW.

“The DOJ has had months and hundreds of agents to put these files together, and yet entire documents are redacted—from the first word to the last,” Garcia said on X. “What are they hiding? The American public deserves transparency. Release all the files now!”

In a joint statement Friday, Garcia and House Judiciary Committee Ranking Member Jamie Raskin (D-Md.) said, “We are now examining all legal options in the face of this violation of federal law.”

“The survivors of this nightmare deserve justice, the co-conspirators must be held accountable, and the American people deserve complete transparency from DOJ,” they added.

Rep. Ro Khanna (D-Calif.)—who along with Rep. Thomas Massie (R-Ky.) introduced the Epstein Files Transparency Act, which was signed into law by Trump last month and required the release of all Epstein materials by December 19—said in a video published after Friday’s document dump that he and Massie “are exploring all options” to hold administration officials accountable.

“It can be the impeachment of people at Justice, inherent contempt, or referring for prosecution those who are obstructing justice,” he added.

“Millions of Americans like you and I could be the target,” warned journalist Ken Klippenstein of the new memo.

A leaked memo written by US Attorney General Pam Bondi directs the Department of Justice to compile a list of potential “domestic terrorism” organizations that espouse “extreme viewpoints on immigration, radical gender ideology, and anti-American sentiment.”

The memo, which was obtained by journalist Ken Klippenstein, expands upon National Security Presidential Memorandum-7 (NSPM-7), a directive signed by President Donald Trump in late September that demanded a “national strategy to investigate and disrupt networks, entities, and organizations that foment political violence so that law enforcement can intervene in criminal conspiracies before they result in violent political acts.”

The new Bondi memo instructs law enforcement agencies to refer “suspected” domestic terrorism cases to the Joint Terrorism Task Forces (JTTFs), which will then undertake an “exhaustive investigation contemplated by NSPM-7” that will incorporate “a focused strategy to root out all culpable participants—including organizers and funders—in all domestic terrorism activities.”

The memo identifies the “domestic terrorism threat” as organizations that use “violence or the threat of violence” to advance political goals such as “opposition to law and immigration enforcement; extreme views in favor of mass migration and open borders; adherence to radical gender ideology, anti-Americanism, anti-capitalism, or anti-Christianity; support for the overthrow of the United States Government; hostility towards traditional views on family, religion, and morality.”

Commenting on the significance of the memo, Klippenstein criticized mainstream media organizations for largely ignoring the implications of NSPM-7, which was drafted and signed in the wake of the murder of right-wing activist Charlie Kirk.

“For months, major media outlets have largely blown off the story of NSPM-7, thinking it was all just Trump bluster and too crazy to be serious,” he wrote. “But a memo like this one shows you that the administration is absolutely taking this seriously—even if the media are not—and is actively working to operationalize NSPM-7.”

Klippenstein also warned that NSPM-7 appeared to be the start of a new “war on terrorism,” but “only this time, millions of Americans like you and I could be the target.”
