The International Criminal Court (ICC) should investigate former US officials President Joe Biden, Secretary of State Antony Blinken and Secretary of Defence Lloyd Austin for their accessorial roles in aiding and abetting, as well as intentionally contributing to, Israeli war crimes and crimes against humanity in Gaza, US civil society organisation Democracy for the Arab World Now (DAWN) has said.

The NGO submitted a 172-page communication to the ICC Prosecutor Karim Khan on 19 January, 2025. Prepared with the support of ICC-registered lawyers and other war crimes experts, the submission details a pattern of deliberate and purposeful decisions by these officials to provide military, political, and public support to facilitate Israeli crimes in Gaza; this support included at least $17.9 billion of weapons transfers, intelligence sharing, targeting assistance, diplomatic protection and official endorsement of Israeli crimes, despite knowledge of how such support had and would substantially enable grave abuses.

“There are solid grounds to investigate Joe Biden, Antony Blinken and Lloyd Austin for complicity in Israel’s crimes,” said Reed Brody, DAWN board member and veteran war crimes lawyer. “The bombs dropped on Palestinian hospitals, schools and homes are American bombs, the campaign of murder and persecution has been carried out with American support. US officials have been aware of exactly what Israel is doing, and yet their support never stopped.”

DAWN’s communication lays out the legal and factual basis for investigating Biden, Blinken, and Austin for violating Articles 25(3)(c) and (d) of the Rome Statute, both aiding and abetting and intentionally contributing to crimes committed by Israeli officials in Gaza. These crimes include those identified in the arrest warrants against Israeli Prime Minister Benjamin Netanyahu and his former Defence Minister Yoav Gallant, including the war crimes of starvation and intentionally directing attacks against the civilian population, and crimes against humanity, including murder, inhumane acts, and persecution, under the Rome Statute. It also includes their role in the war crime of intentionally directing attacks against civilian objects under Article 8(2)(b)(ii) and the crime of genocide under Article 6.

“Not only did Biden, Blinken and Austin ignore and justify the overwhelming evidence of Israel’s grotesque and deliberate crimes, overruling their own staff recommendations to halt weapons transfers to Israel, they doubled down by providing Israel with unconditional military and political support to ensure it could carry out its atrocities,” said Sarah Leah Whitson, Executive Director of DAWN. “They provided Israel with not only essential military support but equally essential political support by vetoing multiple ceasefire resolutions at the UN Security Council to ensure Israel could continue its crimes.”

“Physically dragging out a reporter from the State Department briefing room while preaching press freedom to the rest of the world is the perfect example of the Biden administration’s love affair with double standards and duplicity,” said one foreign policy observer.

Two journalists were removed from Secretary of State Antony Blinken’s final news conference on Thursday after interrupting Blinken’s remarks to heckle him about the United States’ policy toward Gaza, a day after a cease-fire deal between Hamas and Israel was announced. One of the reporters, independent journalist Sam Husseini, was physically carried out of the briefing room by security.

Less than two minutes into Blinken’s remarks, as he was thanking the reporters in the attendance for “asking tough questions,” Max Blumenthal, the editor in chief of The Grayzone—an independent news—addressed Blinken, saying loudly in reference to the cease-fire deal:“300 reporters in Gaza were on the receiving end of your bombs. Why did you keep the bombs flowing when we had a deal in May?” On Wednesday, President Biden announced the breakthrough, saying that “this is the ceasefire agreement I introduced last spring.”

“Why did you sacrifice the rules-based order on the mantle of your commitment to Zionism,” Blumenthal continued, before being led to the door. “How does it feel to have your legacy be genocide?” he yelled.

Blumenthal also called out State Department Spokesman Matt Miller, who is briefly visible in a video filmed by the journalist, who charged that Miller “smirked through a genocide.”

Not long after, Husseini also interrupted Blinken.

“I am asking questions after being told by Matt Miller that he will not answer my questions,” said Husseini, who also referenced the findings of Amnesty International, which concluded in December that Israel has committed genocide against Palestinians in Gaza. “You pontificate about a free press… Criminal! Why aren’t you in the Hague.” The Hague is where the International Criminal Court is located.

Blinken can be heard saying “respect the process” in response to Husseini’s outburst.

Report Says Biden’s ‘Empty Threats’ on Gaza Fed Israeli Impunity

One Middle East expert said that it’s “hard to avoid the conclusion” that the U.S. administration’s ultimatums to Israel “have all just been a smokescreen.”

New reporting published Wednesday details the impotence and insincerity of President Joe Biden’s “multiple threats, warnings, and admonishments” to Israel as it annihilated the Gaza Strip, killing tens of thousands of Palestinian civilians while receiving tens of billions of dollars in U.S. arms and unwavering diplomatic support.

Writing for ProPublica, Brett Murphy showed how multiple “red lines” issued by Biden administration officials were ignored by Israel with impunity. Murphy highlighted Secretary of State Antony Blinken’s October 2024 demand that Israel take “urgent and sustained actions” to improve humanitarian conditions in Gaza—mainly by allowing far more aid into the embattled strip—within 30 days or face a military aid cutoff.

“Netanyahu’s conclusion was that Biden doesn’t have enough oomph to make him pay a price.”

Thirty days came and went without significant improvement or letup in Israel’s onslaught. Yet the Biden administration insisted it found no indication that Israel was using U.S.-supplied weapons illegally. The arms flow continued.

As Murphy reported:

That choice was immediately called into question. On November 14, a U.N. committee said that Israel’s methods in Gaza, including its use of starvation as a weapon, was “consistent with genocide.” Amnesty International went further and concluded a genocide was underway. The International Criminal Court also issued arrest warrants for Israeli Prime Minister Benjamin Netanyahu and his former defense minister for the war crime of deliberately starving civilians, among other allegations.

“Government officials worry Biden’s record of empty threats have given the Israelis a sense of impunity,” wrote Murphy.

Ghaith al-Omari, a senior fellow at the Washington Institute, told Murphy that “Netanyahu’s conclusion was that Biden doesn’t have enough oomph to make him pay a price, so he was willing to ignore him.”

“Part of it is that Netanyahu learned there is no cost to saying ‘no’ to the current president,” al-Omari added.

Conversely, Murphy noted: “On Wednesday, after months of negotiations, Israel and Hamas reached a cease-fire deal. While it will become clear over the next days and months exactly what the contours of the agreement are, why it happened now, and who deserves the most credit, it’s plausible that [U.S. President-elect Donald] Trump’s imminent ascension to the White House was its own form of a red line.”

“Early reports suggest the deal looks similar to what has been on the table for months,” he added, “raising the possibility that if the Biden administration had followed through on its tough words, a deal could have been reached earlier, saving lives.”

As Stephen Walt, a professor of international affairs at Harvard Kennedy School, told Murphy, “It’s hard to avoid the conclusion that [Biden’s] red lines have all just been a smokescreen.”

“The Biden administration decided to be all-in and merely pretended that it was trying to do something,” Walt added, as Israel kept killing Palestinians with U.S.-supplied weapons and continued a “complete siege” blamed for widespread starvation and sickness in the Gaza Strip.

Murphy wrote that Trump “will inherit a demoralized State Department” in which many officials who haven’t already resigned have “become disenchanted with the lofty ideas they thought they represented.”

As one senior department official told Murphy, Gaza “is the human rights atrocity of our time.”

“I work for the department that’s responsible for this policy. I signed up for this,” the official added. “I don’t deserve sympathy for it.”

Multiple human rights organizations and international bodies have accused Israel of committing genocide in Gaza

The administration of US President Joe Biden announced on Saturday an arms sale to Israel valued at $8 billion, just ahead of President-elect Donald Trump’s return to the White House.

Biden has repeatedly rejected calls to suspend military backing for Israel because of the number of civilians killed during the war in Gaza. Israel has killed more than 45,000 people in Gaza, primarily women and children.

The sale includes medium-range air-to-air missiles, 155mm projectile artillery shells for long-range targeting, Hellfire AGM-114 missiles, 500-pound bombs, and more.

Human rights groups, former State Department officials, and Democratic lawmakers have urged the Biden administration to halt arms sales to Israel, citing violations of US laws, including the Leahy Law, as well as international laws and human rights.

The Leahy Law, named after former Sen. Patrick Leahy, requires the US to withhold military assistance from foreign military or law enforcement units if there is credible evidence of human rights violations.

The Council on American-Islamic Relations (CAIR), the nation’s most significant Muslim civil rights and advocacy organization, today called Biden’s new $8 billion arms deal “racist” and “sociopathic.”

Multiple human rights organizations and international bodies have accused Israel of committing genocide in Gaza. The International Criminal Court (ICC) issued arrest warrants for Israeli Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Gallant for committing war crimes.

The US is, by far, the biggest supplier of weapons to Israel, having helped it build one of the most technologically sophisticated militaries in the world.

CAIR National Executive Director Nihad Awad said on Saturday:

“We strongly condemn the Biden administration for its unbelievable and criminal decision to send another $8 billion worth of American weapons to the government of indicted war criminal Benjamin Netanyahu instead of using American leverage to force an end to the genocide in Gaza.

“Only racists who do not view people of color as equally human, and sociopaths who delight in funding mass slaughter, could send Netanyahu even more bombs while his government openly kidnaps doctors, destroys hospitals, and exterminates the last survivors in northern Gaza.

“If President Biden is actually the person who approved this new $8 billion arms sale, then he is a war criminal who belongs in a cell at The Hague alongside Netanyahu. But if Antony Blinken, Brett McGurk, Jake Sullivan, and other aides are making these unconscionable decisions as shadow presidents, then anyone with a conscience in the administration should speak up now about their abuses of power.”

According to the Stockholm International Peace Research Institute (SIPRI), the US accounted for 69% of Israel’s imports of major conventional arms between 2019 and 2023.

On the other hand, incoming President-elect Donald Trump has also pledged unwavering support for Israel and has never committed to supporting an independent Palestinian state.

Rights Group Finds Israel Uses Gaza ‘Safe Zones’ to ‘Hide a Genocide’

The analysis was published a day before Israeli forces bombed yet another “safe zone,” killing at least 12 Palestinians, including children.

A report published on Wednesday details how Israel forcibly expels Palestinians in the Gaza Strip in order to facilitate—and hide—genocidal attacks in evacuated areas, while forcing refugees into alleged humanitarian “safe zones” that are “intentionally designed to ensure the destruction of all life sheltering there.”

The Palestinian human rights group Al-Haq published the report, titled How to Hide a Genocide, which examines “the role of evacuation orders and safe zones in Israel’s genocidal campaign in Gaza.”

According to the report:

Since the very first week of its genocide, Israel has methodically cleared vast stretches of the Gaza Strip of its inhabitants through its unlawful issuance of evacuation orders. Israel presents these evacuation orders to the public as proof of its efforts to minimize civilian casualties and to support its alleged compliance with fundamental principles of international humanitarian law. However, they achieve the direct opposite. Over 90% of Gaza’s population… has been forcibly displaced from their homes and temporary shelters, the majority of them multiple times, to alleged safe zones.

Contrary to their label, these zones are anything but safe. With insufficient space, shelter, sanitation facilities, food, or water sources, and medical care, these safe zones are intentionally designed to ensure the destruction of all life sheltering there. What’s more, the safe zones—despite their unilateral establishment by Israel—are routinely targeted by Israeli occupying forces (IOF) by air, land, and sea. Crowded together with nowhere to flee, Palestinians in Gaza are either killed by Israeli strikes, severely physically and mentally injured by the IOF’s physical and psychological warfare, or subject to a slow death as a result of starvation, dehydration, a complete lack of crucial medical care, or the rampant spread of infectious diseases in the densely populated, unsanitary zones.

Al-Haq said: “As shown throughout the report, by applying humanitarian terms to its practice of forcibly transferring Palestinians, without any legal basis and in a manner that breaches international law, and labeling areas as safe zones despite being constantly attacked and lacking in all essentials for survival, Israel argues that it is acting in accordance with its legal obligations when in fact it is providing further evidence of its genocidal intent as it uses these measures to commit and contribute to the genocidal acts of killing, causing serious bodily and mental harm, and creation of conditions calculated to destroy Palestinians in Gaza.”

The Al-Haq report was published shortly after Sila Mahmoud Al-Faseeh, a 3-week-old baby girl, died from hypothermia in the al-Mawasi safe zone in southern Gaza. She is one of at least eight people—seven of them infants or children—who have reportedly frozen to death in Gaza in recent weeks.

The report was also published a day before Israeli forces bombed a tent encampment in al-Mawasi, killing at least 12 Palestinians including three children and wounding at least 15 others.

It was one of numerous Israeli strikes on the al-Mawasi safe zone, which have killed or wounded at least hundreds of Palestinians. In the deadliest of these, at least 90 Palestinians including many women and children were killed—some of them burned alive in their tents—and hundreds of others were injured when eight 2,000-pound bombs, at least one of which was supplied by the United States, were dropped on the humanitarian zone on July 13, 2024 in order to assassinate Hamas leader Mohammed Deif. Israeli forces then attacked and killed rescue workers arriving at the site of the strike.

U.S. Secretary of State Antony Blinken called the death toll from the strike “unacceptably high.” However, just weeks later, the Biden administration approved approximately $20 billion worth of new U.S. weapons for Israel.

The International Court of Justice in The Hague, Netherlands is currently weighing whether Israel is committing genocide in Gaza.
