A new database of sworn affidavits filed by the ACLU shows masked agents detaining citizens based on race without warrants, ignoring IDs, and pointing weapons at them.

Federal agents deployed to Minnesota by the Trump administration are systematically violating the rights of US citizens and lawful residents, according to more than two dozen sworn affidavits made available this week as part of a class action lawsuit against the Department of Homeland Security.

The suit was filed last month by the ACLU of Minnesota and partnered law firms, which said that as part of President Donald Trump’s Operation Metro Surge, “masked federal agents in the thousands are violently stopping and arresting countless Minnesotans based on nothing more than their race and perceived ethnicity, irrespective of their citizenship or immigration status, or their personal circumstances.”

The case was launched by three plaintiffs, which include 20-year-old Mubashir Khalif Hussein, a Somali-born US citizen whose brutal arrest and detention was caught on video in December. He was placed into a headlock by masked agents and brought to an ICE office, where he said he was left in shackles for an hour and a half before being released miles from his home in the freezing cold.

The plaintiffs called it just one example of a “startling pattern of abuse spearheaded by the Department of Homeland Security (DHS) that is fundamentally altering civic life in the Twin Cities and the state of Minnesota.”

On Thursday, the online legal policy journal Just Security published a searchable database of the 29 sworn declarations filed so far as part of the case. Nearly all of them were filed by US citizens, while a few others were permanent legal residents or had pending legal status.

The statements detail numerous allegations that agents violated their basic constitutional rights, including by detaining them without showing a warrant; targeting Somali and Latino individuals based on their appearances; ignoring identifying documents that could prove their legal residency or citizenship; restraining them violently; and pointing weapons at them during searches.

Last year, the Supreme Court sided with the Trump administration’s claim that when deciding whether to stop someone as part of “roving patrols,” agents had the right to consider certain factors, including “the type of work one does,” a person’s use of Spanish or accented English, or their “apparent race or ethnicity.”

While critics described it as an invitation to blatant and unconstitutional racial profiling and invasions of privacy, Justice Brett Kavanaugh wrote in a concurring opinion that the practice should not prove burdensome to those legally in the US: “If the person is a US citizen or otherwise lawfully in the United States, that individual will be free to go after the brief encounter,” he said.

Ryan Goodman, a law professor at New York University and the co-editor-in-chief of Just Security,said that the “sworn affidavits show how, on the ground, this is simply not how ICE operates.”

“They did not identify themselves, and they did not present a warrant. They just opened my car door and started yanking me out of the car. I kept saying over and over that I was a US citizen.”

One 33-year-old Latino citizen who was born in the US was driving to Menards on January 10 when he suddenly found himself boxed in by two cars at a stoplight. Before he knew it, he said agents were banging aggressively on his windows and one had started pointing a gun at him. When he put his vehicle in park, he said the doors opened automatically.

“When the doors unlocked, the agents did not ask me anything, they did not identify themselves, and they did not present a warrant. They just opened my car door and started yanking me out of the car,” he said. “I kept saying over and over that I was a US citizen.”

“Once they did get my seatbelt off and finally [pulled] me out of the car, they threw me to the ground and pinned me,” he continued. “They were pulling on my arms so tight to put on the handcuffs. They ripped my jacket, and it was torn up. My wallet fell on the ground. I was still repeating that I am a US citizen. I repeated it over and over. They never asked for or looked at my identification.”

The agents hauled the man into their car and began driving him around and interrogating him for about 20 minutes. He said the first question they asked him was his name.

“It seemed if they were going to violently arrest me before even looking at my identification, that they should have known who I was,” the victim said.

Agents eventually realized they’d been searching for another person with the same name and birthdate. They drove their captive behind a warehouse, where nobody could see, and released him. But another agent had taken his car from the intersection. An agent said he’d only give it back if the agent could scan his face, which he did.

“I felt traumatized. My arm hurt, I had bruises from the handcuffs. They were so tight that half of my hand was numb for a few days. I guess it stopped the circulation to my hands while I was handcuffed. I had cuts on my face and hands,” the victim said. “Since this happened to me, I have to pass through that spot every time I drive to work. I keep going back to it and reliving it in my mind.”

According to the database, at least five other US citizens, lawful residents, or legal asylum seekers also claimed in court that they’d had weapons pointed at them by agents during their stops.

Two other US citizens and one lawful permanent resident detailed being subject to physical force during stops.

One 53-year-old Somali man, a US citizen since 2008, said he was physically grabbed and dragged from his car, handcuffed, and pinned against the vehicle by masked agents.

“One officer pressed his knee into my back,” he said. When I screamed out in pain, another officer put his elbow into my neck, and one of the officers yelled at me, ‘Shut the fuck up, son of a bitch!’ One of the officers responded, ‘Why don’t you go back to your country?’“

“I believe that I was stopped solely because of the color of my skin and our appearance, including wearing a hijab.”

One 22-year-old Somali-American citizen who was born in Minnesota said that on January 21, five agents hopped out of their car with multiple guns drawn as she was on her way to work.

She said they demanded to see proof of her citizenship, but rejected her valid ID, claiming it was fake. They demanded to see her passport, which US citizens are not required to carry under US law. The agents told her they did not believe she was a US citizen because of her “accent.”

“I believe that I was stopped solely because of the color of my skin and our appearance, including wearing a hijab,” she said. “It was clear that the ICE agents did not know who I was when they stopped me. I had not violated any traffic laws, and the vehicle I was driving was registered to my mother, who is a United States citizen.”

It’s one of at least five cases in the database in which agents dismissed proof of a citizen or legal resident’s status.

There have also been many other documented instances, including some caught on video, in which agents have detained a citizen or legal resident or refused to let them go because they believed the person’s “accent” did not sound American.

All 29 of those who filed affidavits in the case have alleged unconstitutional racial profiling.

One 25-year-old Somali man, a US citizen born in Atlanta, said a group of masked agents accosted him and his mother while he was shoveling snow.

He said they were joined by a pair of unmasked men who appeared to be livestreaming and helped the agents to box him in. He later identified one of them as a right-wing YouTube influencer named Ben Bergquam.

Even though the vast majority of Somalis living in the US are citizens, he said the agents and the streamers were laughing and referring to him and his mother as “illegal aliens.”

“I was unsure if I was going to be seriously injured or killed.”

At least 12 people in the lawsuit have filed sworn testimony stating that agents forced them to stop while they were driving.

In one case, a Hispanic US citizen said that after following him for a few blocks, agents put on their lights and “rammed” his car off the road.

“An agent came up to my window, asking if I was a citizen. I was furious. I told them I was a citizen and they damaged my car,” he said. “Instead of apologizing, they demanded that I produce documents to prove I was a US citizen. I was too angry. I told them again that I was a US citizen and I didn’t have to prove it to them.”

He said the episode lasted 45-60 minutes, with agents repeatedly demanding his ID, name, and place of birth. Eventually, he says, they confirmed his citizenship by taking photos and videos of him and scanning his license plate.

He said agents told him they would pay for the damages to his car, but that they drove away without providing any insurance information.

“Even though I am a United States citizen and I was carrying proof of my citizenship with me, ICE agents didn’t believe me,” he said. “I felt intense fear and shock. I was unsure if I was going to be seriously injured or killed.”

The affidavits were filed as part of the case Hussen v. Noem, which claims that agents have violated Minnesotans’ rights to equal protection and against unreasonable searches and seizures. A hearing is scheduled to take place later this month.

“The government can’t stop and arrest people based on the color of their skin, or arrest people with no probable cause,” said Kate Huddleston, senior staff attorney with the ACLU’s Immigrants’ Rights Project. “These kinds of police-state tactics are contrary to the basic principles of liberty and equality that remain a bedrock of our legal system and our country.”

A group of Democratic lawmakers on Tuesday demanded the termination of US Homeland Security Secretary Kristi Noem, as new footage emerged in Minneapolis of federal immigration officers drawing guns on unarmed observers.

More than a dozen Democrats serving in the US House of Representatives stood outside the Washington, DC headquarters of US Immigration and Customs Enforcement (ICE) on Tuesday and demanded that President Donald Trump fire Noem, who has taken heat for making false claims in recent weeks about Minneapolis residents Renee Good and Alex Pretti, both of whom were gunned down by federal agents last month.

Rep. Ilhan Omar (D-Minn.) delivered a brief speech at the event where she described her home city of Minneapolis as being under “occupation” by federal agents sent by Trump and Noem.

“We do not exaggerate when we say we have schools where two-thirds of the students are afraid to go to school,” she said. “We do not exaggerate when we say we have people who are afraid to go to the hospital because our hospitals have occupying paramilitary forces. We do not exaggerate when we say our restaurants are shutting down because there are not enough people to drive the employees to work and from work.”

Omar went on to reiterate her past calls to abolish ICE, which she described as “not just rogue, but unlawful.” She also said that “Democrats are ready and willing to impeach” Noem if Trump doesn’t fire her.

Later in the event, Rep. Joaquin Castro (D-Texas) spoke of his meeting last week with Liam Ramos, a 5-year-old boy from Minneapolis who had been detained at a Texas ICE facility before a judge last weekend ordered his release.

“While detained, he became lethargic and sick,” Castro said, speaking of Ramos. “His father said that he’d become depressed. He was asking about his mother and his classmates, and most of all, he wanted to go home. But he also said that he was scared of the guards… he had clearly been traumatized.”

Castro emphasized that, even though Ramos and his father have been freed from detention, there are still too many children being held at the facility, including at least one as young as two years old

“This is a machinery of cruelty and viciousness that Secretary Noem has overseen, the Trump administration has built, and people like Texas Gov. Greg Abbott have been complicit in upholding,” he said. “We must not allow ICE to kidnap children and bring them to prisons where they profit off their pain, misery, and suffering.”

As Democrats were making their case for Noem’s removal, new footage emerged of federal immigration officers in Minneapolis pulling legal observers out of their cars at gun point.

In a video posted on social media by independent journalist Ford Fischer, agents can be seen swarming a vehicle with their guns drawn and demanding and its passengers exit the car.

After the observers were pulled from the vehicle and detained by officers on the scene, one officer in the video claims that the people in question had been threatening them with “hand guns.”

An observer then asks the officer if he means that the people being taken into custody were waving firearms at them, and he replies that they were making fake guns with their fingers, not brandishing actual weapons.

As the officers left the scene, they were heckled by protesters.

“Put away your weapons you douchebag, nobody is threatening you!” yelled one.

As some Democrats suggest compromising in order to reform the agency, Rep. Rashida Tlaib said that “ICE was built on violence and is terrorizing neighborhoods. It will not change.”

President Donald Trump on Tuesday signed a bill to end a brief government shutdown after the US House of Representatives narrowly passed the $1.2 trillion funding package.

While the bill keeps most of the federal government funded until the end of September, lawmakers sidestepped the question of funding for US Immigration and Customs Enforcement (ICE), which Democrats have vowed to block absent reforms to rein in its lawless behavior after the shootings of Renee Good and Alex Pretti in Minneapolis and a rash of other attacks on civil rights.

The bill, which passed on Tuesday by a vote of 217-214, extends funding for ICE’s parent agency, the Department of Homeland Security (DHS), for just two weeks, setting up a battle in the coming weeks on which the party remains split.

While most Democrats voted against Tuesday’s measure, 21 joined the bulk of Republicans to drag it just over the line, despite calls from progressive activists and groups, such as MoveOn, which Axios said peppered lawmakers with letters urging them to use every bit of “leverage” they can to force drastic changes at the agency.

House Appropriations Committee Ranking Member Rosa DeLauro (D-Conn.), who voted for the bill, acknowledged that it was “a leverage tool that people are giving up,” but said funding for the rest of the government took precedence.

The real fight is expected to take place over the next 10 days, with DHS funding set to run out on February 14.

ICE will be funded regardless of whether a new round of DHS funding passes, since Republicans already passed $170 billion in DHS funding in last year’s One Big Beautiful Bill Act.

Democrats in both the House and Senate have laid out lists of reforms they say Republicans must acquiesce to if they want any additional funding for ICE, including requirements that agents nationwide wear body cameras, get judicial warrants for arrests, and adhere to a code of conduct similar to those for state and local law enforcement.

Rep. Pramila Jayapal (D-Wash.), the chair emerita of the Congressional Progressive Caucus who voted against Tuesday’s bill reiterated that in order to pass longterm DHS funding, “there must be due process, a requirement for judicial warrants and bond hearings; every agent must not only have a bodycam but also be required to use it, take off their masks, and, in cases of misconduct, undergo immediate, independent investigations.”

Some critics have pointed out that ICE agents already routinely violate court orders and constitutional requirements, raising questions about whether new laws would even be enforceable.

A memo issued last week, telling agents they do not need to obtain judicial warrants to enter homes, has been described as a blatant violation of the Fourth Amendment. Despite this, House Speaker Mike Johnson (R-La.) said on Tuesday that Republicans will not even consider negotiating the warrant requirement, calling it “unworkable.”

“We cannot trust this DHS, which has already received an unprecedented funding spike for ICE, to operate within the bounds of our Constitution or our laws,” Jayapal said. “And for that reason, we cannot continue to fund them without significant and enforceable guardrails.”

According to recent polls, the vast majority of Democratic voters want to go beyond reforms and push to abolish ICE outright. In the wake of ICE’s reign of terror in Minneapolis, it’s a position that nearly half the country now holds, with more people saying they want the agency to be done away with than saying they want it preserved.

“The American people are begging us to stop sending their tax dollars to execute people in the streets, abduct 5-year-olds, and separate families,” said Rep. Rashida Tlaib (D-Mich.), who gathered with other progressive lawmakers in the cold outside DHS headquarters on Tuesday. “ICE was built on violence and is terrorizing neighborhoods. It will not change… No one should vote to send another cent to DHS.”

Rep. Ilhan Omar (D-Minn.), who comes from the Minnesota Somali community targeted by Trump’s operation there, agreed: “This rogue agency should not receive a single penny. It should be abolished and prosecuted.”

Beyond Corporate Media, Journalists Are Stepping Up and Speaking Up About ICE

As millions around the world, fresh off watching real-time footage of federal law enforcement murdering Renee Good, saw federal agents murder Alex Pretti, CBS viewers got a headline (1/24/26): “Person Dead After Shooting in Minneapolis Involving Federal Immigration Agents.”

You can check your calendar; it is 2026. And yet corporate media still think we’ll fall for that passive voice business, wherein law enforcement are…there…and people just kinda die.

Or we get—as CBS (1/27/26) offered elsewhere—“videos of the incident appear to contradict officials’ claims.”

‘No hate, no fear’

Workday: “Everybody Showed Up”: Stunning Crowds at Minnesota Day of Strike and Shutdown Against ICE

“Every time this country has had a debate on the sustainability and expansion of our democracy,” Chicago Teachers Union president Stacy Davis Gates told Workday (1/23/26), “workers have settled that debate—and I’m looking for workers to do the same thing this time.” 

It’s not clear whether corporate media know they’re writing themselves a resignation letter, but they are. Fortunately, there are other outlets ready to step up and speak up.

You can read Hammer & Hope (Fall/24) for an interview with Doran Schrantz, a longtime organizer of Minnesota’s faith-based communities on “How a Decade of Multiracial, Interfaith Organizing in Minnesota Undergirds the Resistance.” Schrantz explains:

We built a strategy together around how we understand what it means to unequivocally be East African and Muslim. Or rural with a rural perspective. No one’s asking you to change any of those things. We are explicitly posing the question about how we can publicly demonstrate, over and over again, the critical importance of multiracial democratic power. We center this question partially to model, but partially to protect our movements from being distracted and divided by identitarian or weaponized racialized attacks.

You can read Sarah Lazare writing for Workday Magazine (1/23/26) and In These Times (1/23/26) about Minnesota’s January 23 strike and shutdown. Tens of thousands marched through downtown Minneapolis shouting, “No hate, no fear, immigrants are welcome here.”

That action crucially involved workers and unions. A union leader from SEIU Local 26, which represents more than 8,000 of Minnesota’s janitors, window cleaners and property service workers told Lazare they’ve “lost over 20 members to these abductions by federal agents, often without warning, often without due process.”

You can read Katya Schwenk at the Lever (8/28/25), who details how ICE has been allowed to swallow more and more resources based on a broad authority that Congress gave the Department of Homeland Security to reshuffle funds with little oversight.

The latest is DHS draining money from FEMA, tasked with disaster relief but lately wielded as a political cudgel, as when Trump floated the idea that he would deny relief to states that allowed consumers to ban Israeli products. Once an independent agency, FEMA was subsumed into DHS in 2003 as part of George W. Bush’s post-9/11 reorganization.

Congress has repeatedly given DHS authority to move money around in a way not afforded to all departments, who have to trouble with things like approval from lawmakers.

Switching names not changing course

Popular Information: How legacy media fell for Trump’s fake “pivot” in Minnesota

“What is motivating all of the reporting on Trump’s ‘pivot’?” Popular Information (1/28/26) asked. “Trump softened his rhetoric, calling Pretti’s death ‘very unfortunate’ and ‘very sad.’”

You can read Popular Information (1/28/26), which warns of media disinformation around a supposed Trump “pivot” on ICE actions in Minnesota. For instance, AP (1/27/26) reports that Trump has “shifted toward a more conciliatory approach,” that this is an “about face.” The New York Times (1/26/26) ran a headline declaring “Trump Changes Course in Minnesota.” Except that switching names at the top—Homan for Bovino, or anyone for Noem—is actually not proof that the violent crackdown in Minneapolis won’t continue indefinitely.

Popular Information also breaks down, for those interested, the weak corporate response to citizens’ murder by the state. Conspicuously silent after Renee Good’s killing, large companies in Minnesota evidently felt moved to address the issue after Alex Pretti. The Minnesota Chamber of Commerce released a letter on behalf of more than 60 CEOs based in the state that consisted of 215 words that said next to nothing.

“With yesterday’s tragic news, we are calling for an immediate deescalation of tensions and for state, local and federal officials to work together to find real solutions,” the CEOs wrote, with no thoughts on how tensions could be deescalated or what a real solution would look like.

Popular Information contacted all 68 companies that signed the letter, asking: “Do you condemn the killing of two Minnesotans by federal officers?” All either declined to comment or to respond at all.

“They [constitutional observers] are the ones keeping watch,” Immigrant Defense Network’s Edwin Torres Desantiago told Sahan (1/28/26). “They’re the ones that are making sure our constitution is upheld.”You can read, at the Guardian (1/20/26), Alyssa Oursler’s notes on just how grassroots networks in the Twin Cities, with things like community watch and mutual aid, are building on work honed in the 2020 protests in response to George Floyd’s state sanctioned murder. As Oursler quotes one rapid response organizer, “This is not our first rodeo.”

Another aid worker is cited: “We’ve always had to do it ourselves. We have whistles and we have organizing. That’s all we have against people with huge trucks and guns.”

There have been creditable Big Media reports on Minneapolis, but just as events have shown us the need for a disruptive new way forward in politics, they’ve shown up the failures of so-called legacy media to confront the moment, and the value of citizen journalism that doesn’t pretend to come from nowhere, but instead centers the people at the sharp end of the policies crafted by the forces to whom corporate media give pride of place.

Holocaust historian Timothy Snyder said it sounds like ICE is “gearing up for a pogrom in Springfield, Ohio.”

The Trump administration is expected to flood Ohio with immigration agents next week to target thousands of Haitian migrants after they are stripped of their legal status.

One of the main targets will be the town of Springfield, where President Donald Trump and Vice President JD Vance infamously concocted the tale that Haitian immigrants were eating the pets of white residents to stoke xenophobia during the 2024 election, which unleashed an onslaught of racist threats and intimidation upon the community.

Earlier this week, the Springfield News-Sun received a message sent to staff at the Springfield City School District saying that school officials were expecting a federal immigration enforcement operation to begin in the town sometime after February 3, when Haitian residents’ temporary protected status (TPS) expires, and last at least 30 days.

Given that history and the escalating brutality with which US Immigration and Customs Enforcement (ICE) has carried out its recent surges in Minnesota and Maine, Holocaust historian Timothy Snyder said he was “getting the impression that ICE is gearing up for a pogrom in Springfield, Ohio.”

“Any day now, a swarm of armed state police dressed for war could descend” on the town, wrote columnist Marilou Johanek in the Ohio Capital Journal. “The small town of Springfield in Clark County is awaiting an invasion of unaccountable thugs who conceal their faces and identities, drive in unmarked vehicles with blackened windows, stomp on the Bill of Rights, and viciously brutalize human beings based on race and accent.”

The 15,000 Haitians living in Springfield are among around 30,000 in Ohio and more than 500,000 across the US who are expected to lose TPS on Tuesday after it was abruptly revoked by the Department of Homeland Security (DHS) last year. The expiration could be halted by US District Court Judge Ana C. Reyes, who is expected to issue a decision on February 2.

If not, “they could potentially be arrested, detained, or put in removal proceedings unless they have already applied for some other form of relief they have in addition to TPS, or that they are applying for in addition to TPS,” explained Emily Brown, Ohio State University Moritz College of Law’s Immigration Clinic Director to the Journal.

While the Trump administration has often emphasized its supposed targeting of those in the US unlawfully, editor-in-chief David DeWitt at the Journal emphasizes that “Haitians are currently in the United States legally,” under TPS, which grants temporary legal status to those in danger from armed conflict, environmental disasters, or other extraordinary conditions in their home countries.

The Haitians living in the US are at risk of being deported back to what has been described as “the most dangerous country in the world,” in the midst of a gang war that killed over 8,100 people between January and November 2025, according to the United Nations.

“They are not here illegally,” DeWitt wrote on social media. “Trump is revoking their legal status on February 3, and then, according to reports, immediately sending ICE in to Springfield and Columbus, Ohio, to target them.”

As part of a crusade to end migration from impoverished “Third World” countries, Trump has ramped up his use of racist invective against Haiti in recent months, proudly referring to it as a “shithole country” at a rally in December after denying having described it that way back in 2018.

Viles Dorsainvil, executive director of the Haitian Support Center in Springfield, told the Journal that rumors of the coming surge have struck terror into the hearts of many in the community.

“The folks are fearful,” Dorsainvil, who came to the United States from Haiti in 2020, said. “They came here just to work and send their kids to school and be here peacefully. All of a sudden, they find themselves in another scenario where they’re not accepted… They are panicked, and the worst thing is that they can’t even plan their lives for three months down the road.”

One TPS holder, 41-year-old Pushon Jacques, told the News-Sun that the potential loss of his status “has a big impact.” He said: “I won’t be able to work, I will not be able to provide for my family. It’s a bad situation to be in.”

While the administration has emphasized “self-deportation” as a way to avoid being on the business end of an ICE jackboot, Jacques said: “The situation in Haiti—especially the political situation—has made Haiti unlivable… There is no place in Haiti that is safe right now.”

Local reports say residents are already preparing for their town to come under siege, and despite the White House’s portrayal of Haitians as loathed outsiders, many others in the community have come out to support them.

Churches are running immersive role-playing sessions to train community members on what to do if ICE agents attempt to storm their doors, and residents have constructed phone chains to alert vulnerable community members when agents are spotted.

The Springfield City Council, meanwhile, has passed a resolution urging federal agents to comply with city policies that prohibit police from wearing masks and require them to carry identification, though the city has no authority to enforce them.

“Springfield is a good place,” Jacques said. “I like the environment and the people, because Springfield has a lot of good people… I have never felt any racism, and I feel appreciated.”

Despite attacks from the leaders of his party, Ohio Gov. Mike DeWine, a Republican, has defended his state’s Haitian community, telling the statehouse bureau, “I don’t think it’s in our interest in this country for all the Haitians who are working, who are sometimes working two jobs, supporting their family, supporting the economy, I think it’s a mistake to tell these individuals you can no longer work and have to leave the country.”

According to a spokesperson for DeWine, there has been no formal communication between federal authorities and the governor about ICE’s plans for the state. However, DeWine said, “If ICE does in fact come in, comes in with a big operation, obviously we have to work this thing through and make sure people don’t get hurt.”

The ACLU of Ohio said it will be monitoring the situation in Springfield closely for unconstitutional actions.

“This despicable surge in lawless ICE officers descending upon Springfield will ignite swells of fear within the Haitian community, terrorize our Black and Brown neighbors, and cause considerable damage to citizens and non-citizens alike,” said ACLU Ohio executive director J. Bennett Guess.

“Following the government’s senseless, brutal killings of Alex Pretti and Renee Nicole Good in Minneapolis, it is clear that ICE poses a grave threat to all who call Ohio home,” he continued. “The ACLU of Ohio urges state and local elected officials to do everything in their power to protect the 30,000 Haitians living in Central Ohio. We call on the US Congress to reject a DHS budget that allows these lawless agencies to continue putting our communities in danger.”
