“The State Department’s position makes a mockery of U.S. law and assurances provided to Congress,” said Sen. Bernie Sanders.

Sen. Bernie Sanders on Monday said the U.S. State Department’s determination that Israel is not violating international law with its assault on the Gaza Strip is “absurd on its face,” pointing to the mass death, destruction, and starvation that Israeli forces have inflicted on the territory’s population over the past six months.

“Thirty-two thousand Palestinians in Gaza have been killed and almost 75,000 injured, two-thirds of whom are women and children,” Sanders (I-Vt.) said in a statement. “Some 60% of the housing units have been damaged or destroyed, and almost all medical facilities have been made inoperable. Today, hundreds of thousands of Palestinian children are facing starvation because [Israeli Prime Minister Benjamin] Netanyahu won’t let in sufficient humanitarian aid, while thousands of trucks are waiting to get into Gaza.”

“The State Department’s position,” said Sanders, “makes a mockery of U.S. law and assurances provided to Congress.”

The senator’s statement came after State Department spokesperson Matthew Miller told reporters during a press briefing earlier Monday that the Biden administration has not found Israel “to be in violation of international humanitarian law, either when it comes to the conduct of the war or when it comes to the provision of humanitarian assistance.”

Miller was responding to a question about assurances the administration has received from the Israeli government that its use of American weaponry has complied with international law and that it has permitted U.S. humanitarian aid to enter Gaza, where the entire population is facing acute hunger.

Under a new Biden administration policy known as NSM-20, recipients of American military aid are required to provide the U.S. government with “credible and reliable” written assurances that they are using such assistance “in a manner consistent with all applicable international and domestic law and policy.”

Late last week, a group of U.S. senators—including Sanders—warned the Biden administration that deeming Israeli assurances credible would “be inconsistent with the letter and spirit of NSM-20” and “establish an unacceptable precedent” for the application of the policy “in other situations around the world.”

“Until Biden is ready to impose real policy consequences on Netanyahu’s government, the famine will continue.”

It is a violation of U.S. law to continue sending military assistance to a country that is obstructing the delivery of American humanitarian aid. Last month, far-right Israeli Finance Minister Bezalel Smotrich blocked a U.S.-funded flour shipment from entering the Gaza Strip, and Israeli forces have repeatedly fired on convoys attempting to deliver aid to desperate Gazans.

Prominent human rights groups have been calling on the U.S. to impose an arms embargo on Israel for months, pointing to documented examples of the Israeli military using American weaponry to commit atrocities in Gaza.

But the Biden administration has refused to even apply concrete restrictions on American military aid. Over the weekend, U.S. President Joe Biden signed into law a measure that approves $3.8 billion in unconditional military assistance for the Israeli government and imposes a one-year ban on funding for the primary humanitarian aid organization in Gaza.

Jeremy Konyndyk, the president of Refugees International and a former USAID official, said Monday that Israel’s assurances to the U.S. are “not remotely credible” and argued the Biden administration is undermining efforts to combat the worsening humanitarian crisis in Gaza by accepting the Israeli government’s claims.

The U.S., he said, is “talking a big game about fighting the famine that its bombs and diplomatic cover have helped create.” Resorting to “gimmicky” efforts such as airdrops and temporary ports while a U.S. ally obstructs humanitarian aid “is not how you fight a famine,” Konyndyk argued.

“Fundamentally Biden must choose: between continuing to enable Netanyahu, or ending the famine. There’s no way to split the difference,” said Konyndyk. “Until Biden is ready to impose real policy consequences on Netanyahu’s government, the famine will continue.”

“We know Israel won’t comply so long as there are no consequences,” said one advocacy group. “The U.S. must cut off weapons now!”

In news that one policy expert said could have been ripped from the satirical newspaper The Onion, Israeli officials gave a written assurance to the Biden administration on Friday that it would use U.S. weapons in accordance with international law.

The assurance comes more than five months into Israel’s bombardment of Gaza, in which the country’s U.S.-backed military has killed at least 31,490 Palestinians, including more than 12,300 children, while claiming to be targeting Hamas members.

Assal Rad, research director at the National Iranian American Council, noted that Israel has also killed at least 95 journalists in Gaza, attacked healthcare facilities, and starved civilians by blocking humanitarian aid deliveries while explicitly calling on the Israel Defense Forces to commit genocidal acts.

Israeli Defense Minister Yoav Gallant signed the letter to the Biden administration weeks after the White House released a national security memorandum (NSM-20) saying Secretary of State Antony Blinken must “obtain credible and reliable written assurances” from any country receiving U.S. weapons, stating that the country “will use any such defense articles in accordance with international humanitarian law.”

In December, an Amnesty International investigation found that U.S.-made munitions had been used by the IDF in two illegal airstrikes on residential buildings, which killed more than 43 people, including 19 children.

NSM-20 also says a country receiving U.S. arms must “facilitate and not arbitrarily deny, restrict, or otherwise impede, directly or indirectly, the transport or delivery of United States humanitarian assistance and United States government-supported international efforts to provide humanitarian assistance.”

“This is nonsense,” Rohan Talbot, director of advocacy and campaigns for Medical Aid for Palestinians, said of Gallant’s letter on Friday.

While relentlessly assaulting civilian targets in Gaza, Israel has allowed only a fraction of the humanitarian aid that’s needed into the enclave. In recent weeks, the IDF has killed an estimated 400 Palestinians who were trying to access aid, according to officials in Gaza.

According to Axios, which first reported on Israel’s communication, Blinken has until March 25 to certify that Gallant’s assurances are credible.

Gallant is among the top Israeli officials who have used genocidal rhetoric regarding Palestinians since the country began its bombardment in retaliation for the October 7 Hamas-led attack on southern Israel. He said publicly in October that the IDF was fighting “human animals” in Gaza—home to about 2.3 million people, nearly half of whom are children.

The letter from the defense minister amounted to “a sick joke,” said author and political analyst Josh Ruebner.

“Israel’s assurances to President Joe Biden that it won’t use U.S. weapons to violate international law and won’t block U.S. aid from reaching starving Palestinians are clear and blatant lies,” said the Institute for Middle East Understanding. “We know Israel won’t comply so long as there are no consequences. The U.S. must cut off weapons now!”

UN Human Rights Chief Decries ‘War Crime’ of Rapidly Expanding Israeli Settlements

“The West Bank is already in crisis. Yet, settler violence and settlement-related violations have reached shocking new levels, and risk eliminating any practical possibility of establishing a viable Palestinian state.”

The United Nations human rights chief on Friday condemned the record expansion of illegal Israeli apartheid settlements in the occupied West Bank including East Jerusalem and the “dramatic increase” in violence against Palestinians by Israeli occupation forces and settlers, developments that are occurring while the world’s attention is focused on the Gaza genocide.

“Reports this week that Israel plans to build a further 3,476 settler homes in Maale Adumim, Efrat, and Kedar fly in the face of international law,” U.N. High Commissioner for Human Rights Volker Türk said in a statement responding to the far-right Israeli government’s latest settlement expansion scheme.

Türk submitted a report to the U.N. Human Rights Council affirming that Israel is violating the Fourth Geneva Convention by “effectively transferring the civilian population of Israel to the occupied territory while displacing the Palestinian population from their land.”

“Such transfers amount to a war crime that may engage the individual criminal responsibility of those involved,” the report states.

Both the occupation and settlements are illegal under international law. Israel conquered the West Bank, Gaza, and the Golan Heights in Syria in 1967 and has occupied the territories ever since. Although Israeli troops withdrew from Gaza and dismantled Jewish settlements there in 2005, Israel maintains a crippling physical and economic stranglehold that has become a total siege since October 7, when the government of Prime Minister Benjamin Netanyahu launched a genocidal war in response to Hamas-led attacks.

The U.N. report notes that approximately 24,300 new homes in existing Israeli settlements in the West Bank were advanced between November 2022 to the end of October 2023, “the highest on record since monitoring began in 2017.”

According to the publication:

The policies of the current government of Israel appear aligned, to an unprecedented extent, with the goals of the Israeli settler movement to expand long-term control over the West Bank, including East Jerusalem, and to steadily integrate this occupied territory into the state of Israel…

During the reporting period, there was a dramatic increase in the intensity, severity, and regularity of Israeli settler violence against Palestinians, which is accelerating the displacement of Palestinians from their land, in circumstances that may amount to forcible transfer. This violence further spiked following the attacks on October 7, 2023.

“The West Bank is already in crisis. Yet, settler violence and settlement-related violations have reached shocking new levels, and risk eliminating any practical possibility of establishing a viable Palestinian state,” said Türk.

According to the report, Israeli occupation forces and settlers have killed at least 413 Palestinians—including 107 children—while wounding more than 4,600 others in the West Bank since October 7. Palestinians killed 15 Israelis including four soldiers in the occupied territories during the same period.

In one of the most recent incidents, Israeli troops fatally shot 10-year-old Amr Mohammad Ghaleb Najar in the head while he sat in the front seat of his father’s car with his younger brother as they drove through the village of Burin on Monday. Soldiers then opened fire on Palestinians trying to rescue the child, wounding two other people.

Israeli Finance Minister Bezalel Smotrich, who also heads the Civil Administration—the governing body in the occupied territories—said this week that 18,515 new housing units have been approved in the settlements over the past year.

“The enemies try to harm and weaken us, but we will continue to build and be built up in this land,” the far-right minister said on social media.

The administration of U.S. President Joe Biden, which has sanctioned a handful of extremist settlers, last month reversed a Trump-era policy shift under which the United States no longer officially viewed Israeli settlements as illegal. The U.S. State Department first declared the settlements unlawful in 1978.

“Our administration maintains a firm opposition to settlement expansion,” U.S. Secretary of State Antony Blinken said last month. “And in our judgment, this only weakens—it doesn’t strengthen—Israel’s security.”

MORE than 200 lawmakers from 13 countries issued a joint call today against their countries’ arms exports to Israel.

In an open letter, co-ordinated by the Progressive International, 218 lawmakers from 13 countries declared their “commitment to end our nations’ arms sales to the state of Israel.”

The politicians, who serve in parliaments of countries that export weapons or parts to Israel, say they will “not be complicit in Israel’s grave violation of international law” and instead call for an arms embargo, pledging to “immediate and co-ordinated action in their respective legislatures to stop our countries from arming Israel.”

UN Chief Says ‘Rules of War’ Being Disregarded From Ukraine to Gaza

“Today’s warmongers cannot erase the clear lesson of the past,” said United Nations Secretary-General António Guterres. “Protecting human rights protects us all.”

The head of the United Nations said Monday that countries and groups involved in wars around the world are “turning a blind eye to international law” and imperiling the lives of millions of innocent people, including many children.

“The rule of law, and the rules of war, are being undermined,” U.N. Secretary-General António Guterres said in remarks to the Human Rights Council in Geneva.

Guterres pointed specifically to conflicts raging in Ukraine, Gaza, and Sudan and lamented that the U.N. Security Council has frequently been “deadlocked” in the face of mass atrocities, “unable to act on the most significant peace and security issues of our time.”

“The council’s lack of unity on Russia’s invasion of Ukraine, and on Israel’s military operations in Gaza following the horrific terror attacks by Hamas on 7 October, has severely—perhaps fatally—undermined its authority,” said Guterres, who delivered his address less than a week after the U.S. used its veto power for the third time since October 7 to tank a Gaza cease-fire resolution at the U.N. Security Council.

“Flouting international law only feeds insecurity and results in more bloodshed.”

Guterres’ speech marked the start of the Human Rights Council’s first high-level session of 2024. The U.N. chief said at the session that the world “urgently” needs a “new commitment to all human rights—civil, cultural, economic, political, and social—as they apply to peace and security, backed by serious efforts at implementation and accountability.”

Toward that end, Guterres announced the launch of a “systemwide United Nations Agenda for Protection” under which U.N. bodies “will act as one to prevent human rights violations, and to identify and respond to them when they take place.”

“Flouting international law only feeds insecurity and results in more bloodshed,” Guterres warned. “Human rights conventions and humanitarian law are based on cold, hard reality: They recognize that terrorizing civilians and depriving them of food, water, and healthcare is a recipe for endless anger, alienation, extremism, and conflict.”

“Today’s warmongers cannot erase the clear lesson of the past,” he added. “Protecting human rights protects us all.”

Guterres’ address came after Human Rights Watch and Amnesty International said in separate analyses published Monday that Israel is blatantly disregarding an interim ruling handed down last month by the U.N.’s highest legal body, the International Court of Justice (ICJ).

Israeli forces have killed more than 3,400 people in Gaza since the ICJ’s January 26 ruling, and nearly 30,000 total since their assault on the Palestinian enclave began following a deadly Hamas-led attack on October 7.

“Not only has Israel created one of the worst humanitarian crises in the world, but it is also displaying a callous indifference to the fate of Gaza’s population by creating conditions which the ICJ has said places them at imminent risk of genocide,” Heba Morayef, Amnesty’s regional director for the Middle East and North Africa, said in a statement.

“Time and time again,” Morayef added, “Israel has failed to take the bare minimum steps humanitarians have desperately pleaded for that are clearly within its power to alleviate the suffering of Palestinian civilians in Gaza.”

In his remarks Monday, Guterres warned that an Israeli ground assault on the southern Gaza city of Rafah “would not only be terrifying for more than a million Palestinian civilians sheltering there; it would put the final nail in the coffin of our aid programs.”

“International humanitarian law remains under attack. Tens of thousands of civilians, including women and children, have been killed in Gaza,” said Guterres. “I repeat my call for a humanitarian cease-fire and the immediate and unconditional release of all hostages.”
