When the former nurse was found guilty of murdering seven babies and attempting to murder seven others, a 1980s research paper was key to the prosecution’s case. But the author of the paper himself believes there has been a miscarriage of justice – and so too do other doctors

On 4 February 2025, Lucy Letby’s barrister, Mark McDonald, convened a press conference at the grand baroque Westminster venue One Great George Street. It became a landmark moment, the culmination of months in which a number of distinguished experts had spoken out to question the former nurse’s convictions.

The media were addressed for an hour by a Canadian medical professor, Dr Shoo Lee. He said that a panel of international experts disputed the prosecution case that had led to Letby being found guilty in two trials of murdering seven babies at the Countess of Chester hospital in 2015 and 2016, and attempting to murder seven others. She was sentenced to 15 whole-life orders, and the court of appeal unanimously refused her permission to appeal.

“We did not find any murders,” Lee said. “In all cases, death or injury were due to natural causes or just bad medical care.”

Lee is one of the world’s leading neonatologists – doctors who specialise in the medical science and care of premature babies. Before his retirement from clinical practice in 2021, he held senior leadership positions in Canada, headed up international collaborations and conducted extensive research. His journey to becoming so involved in a criminal process pursued in the provinces of north-west England is a remarkable feature of the Letby case. It springs from Lee being told, after Letby was convicted, that a medical research paper he authored more than 30 years ago had been used as a basis for one of the prosecution’s central allegations – that Letby killed babies by injecting air into their veins.

Lee was dismayed, he told the Guardian, adding that the use of his paper was “incorrect” and a “categorical error”, and he was concerned Letby may have been wrongly convicted. He agreed to give evidence to the court of appeal but the judges dismissed it as “irrelevant” when they refused Letby’s application. He then committed to assembling a world-class panel who would fully assess the evidence. Lee’s eminence meant that the peers he could call on comprised leading specialists in Canada, the US, Japan and Europe, including two distinguished UK-based consultants, Dr Neena Modi, a pre-eminent neonatologist, and the renowned perinatal pathologist Dr Marta Cohen. Lee flew across the Atlantic at his own expense to present their findings at that bombshell press conference.

He explained the acute medical problems some of the premature babies had suffered, and said the panel found “no medical evidence to support malfeasance” or deliberate harm. But they had identified “so many problems” with the babies’ care, in a unit that had “inadequate numbers of appropriately trained” staff.

“If this had happened at a hospital in Canada,” Lee said bluntly, “it would have been shut down.”

DOSSIER: The lawyers hand in the evidence to New Scotland Yard

POLICE are assessing evidence that 10 British nationals committed war crimes in Gaza including sniping down children and aid workers.

Lawyers handed evidence accusing the group of the murder and torture of civilians while on active service with the Israeli military to the Metropolitan Police’s war crimes unit yesterday.

Speaking outside New Scotland Yard, they said their 240-page dossier is “just the tip of the iceberg,” with reports of more than 100 Britons having served with Israeli Defence Forces (IDF) since October 2023.

Nearly 100 legal and human rights experts have signed a letter urging the War Crimes Team to investigate the dossier by the Palestinian Centre for Human Rights (PCHR) and the Public Interest Law Centre (PILC).

PILC legal director and founder Paul Heron said that the report is based on six months of extensive evidence-gathering using open-source evidence and witness testimony.

It shows 10 Britons “committed war crimes and crimes against humanity while serving for the Israeli military on active service in Gaza,” he said.

SINCE the Netanyahu government engineered the collapse of the ceasefire, Israel’s crimes in Gaza have escalated horrifically, killing 400 people in one night and more than 100 children a day on average since last month.

Israel has been exposed executing paramedics and rescue workers and hiding their bodies and vehicles and has killed more journalists during the genocide than died during the US civil war, both world wars, Korea, Vietnam, Cambodia, Laos, Yugoslavia, Afghanistan and Russia combined.

Yet the Western media will keep treating Israeli lies about war crimes as credible claims

So what we have here is an unbelievably grave war crime – the massacre of 15 Red Crescent medics and first responders, which the Israeli military covered up and lied about.

If this had been 15 Israeli medics and first responders butchered by Hamas, the media coverage would be deafening. It would be front page news and lead news bulletins. Every Western leader under the sun would issue damning statements condemning the utter evil of Hamas.Subscribe

But these victims were Palestinian. On the BBC news website, it’s four stories down – but most damningly, the headline is: “Video footage appears to contradict Israeli account of Gaza medic killings.”

Appears” to contradict? What does this even mean? The footage definitively proves the Israeli account is a litany of lies. What possible room for doubt exists here?

Just imagine this footage had never been uncovered. Indeed, in the case of so many of Israel’s war crimes, there is no such footage, and Israeli claims are simply allowed to stand.

And what’s even more disturbing is this will not change the Western media’s modus operandi. As I’ve noted, Western media outlets have done rebuttals of Israeli claims before. CNN took apart Israeli claims about the so-called Flour Massacre, when over 100 Palestinians were massacred while waiting for flour. The Washington Post took apart Israel’s claims about the November 2023 assault on al-Shifa hospital. The New York Times examined how, contrary to Israeli claims, 2,000lb bombs were being dropped on so-called ‘safe zones’ by the Israeli military.

The point isn’t just that these rebuttals aren’t frequent enough, or given proper prominence, or treated with the requisite gravity – i.e. as evidence of extreme war crimes. It’s that they are orphaned from the wider narrative. Western media outlets should make clear that Israel has a proven record of entirely false statements about such atrocities. But, like a perverse Groundhog Day, they act as though these rebuttals never happened.

Review into accountability soon to report as police seek greater protection from prosecution over use of force

Police want changes to the law giving them “a licence to kill”, leading rights groups have warned as the government prepares to give officers new protections from prosecution.

A government-ordered review into police accountability is expected to report within weeks. It followed fears of a walkout by angry armed officers in London after a police marksman, Martyn Blake, was tried for murder over the shooting of Chris Kaba. Blake was acquitted in October by a jury in three hours.

Police say they want the system to be fairer and protect officers who use force as part of their duties. Rights groups believe the system holding police to account is already too weak, and diluting it would “undermine public trust”.

In a letter seen by the Guardian, groups including Inquest, the Centre for Women’s Justice, Liberty and Black Lives Matter warn the home secretary, Yvette Cooper, against weakening police accountability.

“This review is less a kneejerk reaction but rather a dangerous and calculated attempt to use a high-profile case to push for less scrutiny and accountability of police actions,” they said.

“The number of cases where police officers are prosecuted for a death is vanishingly small (since 1990 there has only been one successful prosecution of an officer for manslaughter and none for murder).

A group of UN experts on Monday said that Israel “must face the consequences” of its campaign to undermine the legal framework for the protection of civilians in armed conflicts as the military aggression continues unabated, Anadolu Agency reports.

“As we have repeatedly reminded Israel, international humanitarian law comprises a set of universal and binding rules to protect civilian objects and persons who are not, or are no longer, directly participating in hostilities and limits permissible means and methods of warfare,” the experts said in a statement.

“Rather than abide by these rules, Israel has openly defied international law time and again, inflicting maximum suffering on civilians in the occupied Palestinian territory and beyond,” they added.

Citing Israel’s international law violations, the experts said Tel Aviv committed “crimes against humanity including murder, torture, sexual violence, and repeated forced displacement amounting to forcible transfer, war crimes encompassing indiscriminate attacks on civilians and civilian objects, including objects indispensable to the survival of the civilian population and educational institutions and cultural heritage, the use of starvation as a weapon of war, the targeting of healthcare workers and health facilities, attacks on humanitarian workers, arbitrary restrictions on access to humanitarian aid, and attacks on journalists, collective punishment and perfidy.”

“Political and judicial actors must consider the totality of such acts against the entire civilian population under Israeli occupation, who are protected persons and do not constitute military objectives under international law,” they said. “Acts aimed at their destruction in whole or in part are genocidal.”

Israel “grievously” violated its obligations as an occupying power, the experts said, regarding the situation in northern Gaza.

“Indiscriminate attacks, including on shelters for displaced persons and the Kamal Adwan Hospital and its vicinity, and the intensification of siege conditions on northern Gaza for the last three months run contrary to Israel’s legal duty to ensure the protection of the civilian population,” they said.

“We are disturbed that this siege, coupled with expanding evacuation orders, appears intended to permanently displace the local population as a precursor to Gaza’s annexation in further violation of international law.”

Although Israel’s presence in the occupied Palestinian territory was labeled “unlawful” by the International Court of Justice and International Criminal Court issued arrest warrants for Israel’s Prime Minister Benjamin Netanyahu and former defense minister, the experts said: “Nonetheless, Israel continues to face no real consequences, largely due to protection offered by its allies, who have gone so far as to join Israel in delegitimizing international institutions and besmirching Special Procedures mandate-holders.”

The experts reiterated the urgency of allowing independent and thorough investigations of serious violations of international law.

“Israel’s continued impunity sends a dangerous message suggesting that parties to other conflicts around the world need not comply with their obligations under international humanitarian law,” they said. “We cannot afford to lose the force of the multilateral system. Israel and its leaders must be held accountable.”
