“This lawless killing for content cannot become mere background noise,” said one critic.
US Southern Command (SOUTHCOM) said on Friday that it had conducted yet another lethal boat strike on a suspected drug boat traveling in what it described as “known narco-trafficking routes in the Eastern Pacific.”
While SOUTHCOM initially said that three men survived the Thursday strike, a spokesperson for the US Coast Guard subsequently told CNN reporter Zachary Cohen that two of the men on the boat were killed, while a lone survivor was rescued and taken into custody by authorities in Costa Rica.
According to Cohen, at least 160 people have so far been killed by the Trump administration’s boat strikes, which several legal experts have described as illegal acts of murder.
The latest strike on a suspected drug vessel came on the same day Gen. Francis L. Donovan, the commander of SOUTHCOM, told the Senate Armed Services Committee that the Trump administration’s boat-bombing spree is “not the answer” to the drug addiction crisis in the US.
As reported by The New York Times on Thursday, Donovan told lawmakers that the strikes are “probably not the most effective” tool to combat illicit drug trafficking, and said he was developing a more comprehensive plan to stop the flow of drugs into the US.
Human rights group Amnesty International slammed Donovan for carrying out another strike even while acknowledging their negligible impact on the drug trade.
“Congress must take action against these strikes!” the group said in a social media post.
Brian Finucane, senior adviser at the International Crisis Group, expressed concern that the Trump administration’s Iran war was distracting from the other illegal killing it is carrying out.
“This lawless killing for content cannot become mere background noise,” he wrote.
A coalition of rights organizations led by the ACLU last year sued the Trump administration to demand it release documents that provide legal justification for its boat-bombing campaign.
The groups said that the Trump administration’s rationales for the strikes deserve special scrutiny because their justification hinges on claims that the US is in an “armed conflict” with international drug cartels akin to past conflicts between the US government and terrorist organizations such as al-Qaeda.
The groups argued there is simply no way that drug cartels can be classified under the same umbrella as terrorist organizations, given that the law regarding war with nonstate actors says that any organizations considered to be in armed conflict with the US must be an “organized armed group” that is structured like a conventional military and engaged in “protracted armed violence” with the US government.

Insane rulers rarely stop themselves: they’re stopped when the people around them decide the country matters more than the crown.
When Louise and I lived in Germany in the 1980s, we visited Neuschwanstein Castle, the fantasy palace perched on a Bavarian cliff that looks like it escaped from a fairy tale. Tour guides will tell you about its beauty and its role as an inspiration for Disney, but they’ll also share a more unsettling story that today echoes Donald Trump.
Neuschwanstein was built by King Ludwig II, a ruler who withdrew from reality, governed through spectacle instead of policy, ignored his ministers, and bankrupted Bavaria by indulging his own grandiosity and a never-ending stream of construction and renovation projects. (Neuschwanstein was only one of three castles he built.) Bavaria eventually dealt with Mad King Ludwig: his own government declared him mentally unfit to rule and removed him from the throne.
That memory of Ludwig and his architectural obsessions has been haunting me lately, and it’s frankly astonishing that more people in the media aren’t asking the same question I’m bringing up here (and people are constantly calling into my radio/TV show about): “Is Trump losing his sanity?”
I’m not talking about his well-documented lifelong narcissism, his sociopathic inability to feel or even understand the pain of other people, his bullying, or even his compulsive lying, greed, and lechery; this is about whether he’s fit for the job he’s holding or is losing his touch with reality in a way that endangers both our nation and world peace.
When Trump held his press conference announcing the invasion of Venezuela and the arrest of Nicolás Maduro, a reporter asked the most basic question imaginable: Who is running Venezuela now and going forward?
Trump first claimed that he was in charge, but then when other reporters asked for details he waved his hand toward the men standing behind him and said, “They are.” Marco Rubio, Stephen Miller, General Dan Caine, and Pete Hegseth.
The expressions on their faces told the real story: Surprise, confusion, and even alarm. This was clearly, visibly news to them. Shocking news, even.
Did he just decide to BS his way through the press conference like he’s done so much of his life? Didn’t he realize this was a violation of both international law and the US Constitution? Did he think for a moment that he’s the king of the Americas? Or the world?
The next day we discovered the truth their expressions revealed; there was no plan for governing Venezuela, or even trying to via an occupation Iraq-style. There was no congressional authorization; in fact, he told the oil companies before the raid but didn’t bother to inform Congress until yesterday. (Although the oil companies now say he’s lying.)
There was no public debate and no involvement of any visible constitutional process involved in this invasion and body-snatch. Under our federal system, the president doesn’t get to just improvise an occupation or administration of a foreign nation from a podium.
Even Nixon, Reagan, Bush, and Bush didn’t try to pull that off; all sought congressional authorizations for their wars and each gave explanations that at least gave a hat-tip to the traditional American values of democracy, peace, and the rule of law.
Congress, after all, declares war under our Constitution, as well as controlling the purse that makes that war possible. Even the idea of “running” another country would require massive legal, diplomatic, and military frameworks, and now we discover that none of that stuff existed. Instead, apparently, Trump had an impulsive thought or idea and just blurted it out.
That moment should have set off loud alarms throughout Washington and should have shot across our media like a meteorite. Instead, it drifted by as simply another strange episode in a presidency that’s taught us to pretend the abnormal is now normal.
Democrats (and a few Republicans) condemned Trump’s claim that he was running Venezuela; Republican politicians are now twisting themselves into pretzels to try to justify it. Reporters were simply confused. It’s nuts.
And in just the few days since then, Trump has openly threatened to seize Greenland, Cuba, Colombia, even Mexico. These aren’t policy proposals. They also aren’t rooted in American or international law, military or political strategy, or diplomacy.
They are, instead, Mad King Ludwig-like expressions of personal fantasy, of imperial imagination, of a man who appears increasingly convinced — who actually believes — that all power in America and perhaps around the world flows from his will alone.
And then there’s Trump’s bizarre online behavior, like posting over 100 times a night, and promoting a tweet saying that Minnesota Governor Tim Walz had hired a hit on State Representative Melissa Hortman and her husband, close personal friends of Walz’s.
Or his refusal to consider the last Venezuelan election winner, María Corina Machado, to run the country because she “stole” the Nobel prize from him.
Rachel Maddow last night on her television program suggested that the real reason Trump invaded Venezuela was simply because he could. Like a child, or a mad king, he wanted to play with his soldiers, watch them kill people and blow things up, and he doesn’t want anybody to tell him that he can’t.
And, I would add, eventually he plans to turn them on people like you and me. Once he’s made sure they’ll do anything he demands, no matter how bizarre, no matter how wrong, no matter how illegal. That’s why he’s now going after Senator Mark Kelly and other members of Congress for telling soldiers they don’t have to follow illegal orders.
Lev Parnas, who once worked closely with Trump and still hears from people inside his orbit, writes that Trump is receiving regular intravenous infusions of a new Alzheimer’s medication, administered through veins in his hands, whose known side effects include “sleepiness” during the day, “poor judgment,” and “impaired impulse control.” It could explain the bruises, the CT scans and MRIs, and the regular cognitive tests that the medication requires.
Not to mention the increasingly bizarre and grandiose behavior.
I’m not diagnosing Trump, but I am watching — a shocked world is watching — a pattern of behavior that is becoming more erratic, more impulsive, and more detached from constitutional reality week by painful week.
This also isn’t a partisan observation; I’m describing precisely the scenario the Framers and a later Congress worried about when they designed safeguards for presidential incapacity. The 25th Amendment wasn’t written for removing villains but rather for those moments when a president can’t or won’t reliably discharge the duties of his office but doesn’t have the good grace, insight, or ability to step down himself.
But constitutional tools are only as strong as the people willing to use them.
Bavaria in the nineteenth century had fewer options than we do. It had no elections to depose Mad King Ludwig, and no amendment laying out a clear procedure for replacing him.
For years, Ludwig had ministers serving him who watched how crazy he’d become but nonetheless delayed, rationalized, and hoped the problem would solve itself. It wasn’t until the damage became so great, as the state trembled on the verge of bankruptcy, that it was impossible to ignore any longer.
Modern America, on the other hand, has elections, courts, and a theoretically independent Congress. And we have the 25th Amendment. What we lack right now, however, is courage in the GOP and Trump’s cabinet.
Republican members of Congress know that a president can’t unilaterally invade or administer foreign nations on his own whim or impulse. They know that threatening annexation destabilizes the entire world, and Trump’s handed both Putin, Netanyahu, and Xi the rationalizations they all crave to expand their own empires.
Even Republicans know that governing by impulse isn’t strength but, instead, represents a very real danger to our republic. And yet they remain silent, calculating that confronting Trump is riskier to their careers than indulging him is to the country.
That GOP calculation is the real threat.
Trump’s love of military spectacle also fits perfectly — and dangerously — into this pattern. Like Ludwig staging operas and medieval fantasies in his version of the Kennedy Center, Trump treats America’s armed forces as props in his own pathetic personal drama. Rallies, salutes, parades, flyovers, and dramatic announcements substitute for deliberation, applause substitutes for legitimacy, and the human costs, the constitutional limits, and the long-term consequences are all fading into the background.
Neuschwanstein still stands today, beautiful and empty, a monument to what happens when fantasy replaces governance. Bavaria survived despite Ludwig, not because of him. Twenty-first century America, however, doesn’t have the luxury of turning its current ruler into a picturesque lesson (complete with a Ludwig-style ballroom) after the damage is done. A nuclear-armed superpower can’t afford indulgence that’s pretending to be patience.
The Constitution isn’t self-enforcing and doesn’t rise up on its own when norms are trampled. It instead relies on people in positions of authority to choose responsibility over fear; that’s why federal officials and our soldiers pledge their allegiance to our Constitution rather than to our government or any particular administration or person.
We hold the rulebook sacred, not the rulers.
If Republicans continue to refuse to even acknowledge the danger in front of them, history suggests the reckoning will come anyway, just at a far higher cost.
Bavaria eventually acted, not because it was easy but because delay had become more dangerous than dealing with a psychologically incapacitated and emotionally stunted ruler. The question facing the United States today is whether we’ll learn from that history or insist on repeating it.

“By targeting beliefs and protest activity, the directive positions dissent itself as a potential crime,” one news organization said.
In between his highly publicized designation of Antifa as a domestic terror organization and his indictment of former FBI Director James Comey, US President Donald Trump signed a little-reported national security memorandum that gives law enforcement new tools to target his critics.
Trump signed National Security Presidential Memorandum 7 (NSPM-7) on Thursday. The directive, titled “Countering Domestic Terrorism and Organized Political Violence,” focuses exclusively on “anti-fascist” or left-wing activities, and mandates a “national strategy to investigate and disrupt networks, entities, and organizations that foment political violence so that law enforcement can intervene in criminal conspiracies before they result in violent political acts.”
“I don’t want to sound hyperbolic but the plain truth is that NSPM-7 is a declaration of war on anyone who does not support the Trump administration and its agenda,” journalist Ken Klippenstein wrote in a piece raising alarm about the directive on Saturday.
Klippenstein argued that the memorandum was worrying on several fronts. For one, its focus on preventing crimes before they are committed opens the door to rights violations.
“In other words, they’re targeting pre-crime, to reference Minority Report,” Klippenstein wrote.
For another, the memorandum casts a very wide net, targeting groups, individuals, funders, and “entities” and listing several protected beliefs as “indicia” of extremism.
These include:
“Anti-Americanism, anti-capitalism, and anti-Christianity;
Support for the overthrow of the United States Government;
Extremism on migration, race, and gender; and
Hostility towards those who hold traditional American views on family, religion, and morality.”
What’s more, the memorandum entrusts enforcement to the FBI’s over 4,000-strong Joint Terrorism Task Forces (JTTF), which removes the legal challenges to directing the National Guard or other military forces to quash domestic dissent.
“For the Trump White House, the beauty of using an already existing network is that it bypasses Congressional oversight and scrutiny and even obscures federal activity to governors and legislatures at the state level,” Klippenstein wrote.

The types of activities that will be targeted are also quite broad, with the document defining “organized doxing campaigns, swatting, rioting, looting, trespass, assault, destruction of property, threats of violence, and civil disorder” as “domestic terrorist acts.”
The memorandum also targets any individual or group who might fund activity the administration deems terrorism and directs the Internal Revenue Service to “take action to ensure that no tax-exempt entities are directly or indirectly financing political violence or domestic terrorism,” which could be a means of threatening the status of nonprofits.
Finally, as Drop Site News pointed out, the memo authorizes the attorney general to designate domestic groups as terrorist organizations for the first time in US history.

The Trump administration’s focus on violence associated with left-wing beliefs and groups is not supported by the facts. National Institute of Justice data found that right-wing violence had led to 520 deaths since 1990 compared with 78 deaths due to left-wing violence. However, the administration removed that study from the Department of Justice website shortly after Charlie Kirk was killed, The Guardian reported earlier this month.
The administration’s efforts, while accelerated, build on processes that began during the US response to the September 11 attacks, as Klippenstein explained:
A “pre-crime” endeavor, preventing attacks before they happen, is core to the post-9/11 concept of counterterrorism itself. No longer satisfied to investigate acts of terrorism after the fact to bring terrorists to justice, the Bush administration adopted preemption. Overseas, that led to aerial assassination by drones and “special operations” kill missions. Domestically, it led to a counter-terrorism campaign whose hallmark was excessive and illegal government surveillance and the use of undercover agents and “confidential human sources” to trap (and entrap) would-be terrorists.
However, the Trump administration is expanding the War-on-Terror mandate with fewer guardrails.
“Now, with Donald Trump’s directive retooling the counter-terror apparatus to go after Americans at home, this means monitoring political activity, or speech, as an investigative method to discover ‘radicalism,‘” Klippenstein said, noting that the NSPM-7 breaks with post-Watergate national security documents by failing to mention the First Amendment rights to protest and organize.
White House Deputy Chief of Staff Stephen Miller is already eager to make use of the document.
“We are witnessing domestic terrorist sedition against the federal government,” he wrote on social media on Friday. “The JTTF has been dispatched by the Attorney General, pursuant to NSPM-7. All necessary resources will be utilized.”
In an interview with Greg Sargent for the New Republic, Trump ally Steve Bannon confirmed that Miller and others in the administration were preparing to go after left-liberal groups and media whose criticism of Immigration and Customs Enforcement (ICE) could be interpreted as “goading” on violence against the agency.
Referring to Miller’s comments that calling ICE authoritarian incited violence and terrorism, Bannon responded, “Stephen Miller is correct—more importantly he’s in charge.”
The threats of investigations put liberal and left-leaning organizations in a tough place. On the one hand, they want to prepare as best they can. On the other, they do not want to obey in advance.
“Officials at these groups tell me they must strike a balance between being clear-eyed about how bad this could get while not letting it discourage political activity,” Sargent wrote. “That latter form of surrender is exactly what Trump and Miller want. And under no circumstances should anybody willingly hand it over to them.”

According to the Miami Herald, over 1,000 detainees in Florida’s immigrant internment camp have effectively “disappeared,” with family and attorneys unable to track their whereabouts.
Immigrant rights activists in Florida are expressing alarm as they have found themselves “unable to locate” more than 1,000 detainees who have been “administratively disappeared” from the state’s immigrant internment camp known as ”Alligator Alcatraz.”
Last week, the Miami Heraldreported that “the whereabouts of two-thirds of more than 1,800 men detained at Alligator Alcatraz during the month of July could not be determined” after the paper “obtained the names from two detainee rosters.”
The reporters found that around 800 of the people on the rosters do not appear on Immigration and Customs Enforcement’s (ICE) Online Detainee Locator System, which provides publicly available information about the court status and locations of people who have been jailed by immigration enforcement. Another 450 had no location listed and instead merely instructed users to “Call ICE for details.”
The Herald also found that the vast majority of the detainees in the system did not have final orders of removal issued against them by immigration judges, which would be required for their deportation. Nevertheless, the detainees’ families and attorneys have been left unable to find them.
Detainees and other witnesses, including several members of Congress who visited in July, have described the conditions inside Alligator Alcatraz as horrific. The ramshackle tent camp was set up in a matter of days this summer in the Everglades to warehouse thousands of people detained by ICE, often without criminal charges or warrants, and with restricted access to attorneys.
While people in federal immigration facilities are typically able to be tracked through the system, the state-run Alligator Alcatraz works differently.

Shirsho Dasgupta, one of the reporters who broke the story for the Herald, told Democracy Now! on Thursday that attorneys he’s spoken to often “don’t know who to call” to get in contact with their clients.
Operations at Alligator Alcatraz were briefly halted in August when a federal district judge ruled against the facility on environmental grounds. But that ruling was stayed by a federal appeals court just two weeks later, allowing operations to resume.
While the state of Florida runs the facility, it has requested and was promised reimbursement from the Federal Emergency Management Agency’s (FEMA) Shelter and Services Program, which was initially created to provide housing and other services to individuals released from ICE custody who were awaiting immigration court proceedings.
In a statement on Friday, the Florida Immigrant Coalition (FLIC), which has also attempted to track the detainees, said that the Herald’s report shows what they “have been warning about for months,” that “those detained in this detention camp have effectively been administratively disappeared.”
FLIC said that the state of Florida has refused to confirm how many detainees are currently in Alligator Alcatraz and that, in addition to those not listed on the ICE locator tool, they have also seen people deported before scheduled bond hearings. The group also said it had “confirmed data showing Florida is lying when claiming those detained at the Everglades camp had final orders of removal.”
“Since this depraved torture camp funded with state FEMA funds reopened,” said Tessa Petit, FLIC’s executive director, “we have been unable to locate the fathers, brothers, friends, and sons that are caged there without due process in the ICE locator. Hospitalizations for severe medical incidents, which include cardiac incidents and surgeries, go unreported.”
Thomas Kennedy, a policy analyst at FLIC, said: “What we’re seeing at Alligator Alcatraz is basically a new model of immigration detention, where a state-run facility is operating as an extrajudicial black site, completely outside of the previous models of immigration detention in this country. It’s making what was already a terrible system somehow even worse.”
